Purpose: The RoseviIle City Code, Title 10, Sections 1014, <br />12 Subsectionl014.04 is hereby amended by revising language regarding the designation and <br />13 operation for the City of RoseviIle Board of Adjustment and Appeals to allow for more <br />14 efficient use of the Planning Commission and City Council meetings, by creating <br />15 designating a Variance Board and designating three members Planning Commission to <br />16 serve as such Board. <br /> <br />:; V~SECTION 2. CHAPTER 1014.04 is hereby amended to read as follows: t!af2;ti <br />19 <br />20 /1014.04: BOARD OF ZONING ADJUSTMENTS AND APPE : <br />21 . The city council shall annuall desi nate three members of the Plannin ommission to act as, <br />22 "the. Board of Zoning Adjustments and Appeals pursuant to Minneso tatutes Chapter 462. <br />23 Requests for variances, . shall be processed by the <br />24 community development director or his or her designee in accordance with the provisions of <br />25 chapter 1013 of this title or other relevant section of this code and Minnesota Statutes 15.99. <br />26 <br />27 An appeal from the ruling of the Community Development Director or his/her designee <br />28 regarding any interpretation of the legislative intent of this title or title 11 of this code, or any <br />29 action approving or denying an application related to any matter addressed in this title or title 11 <br />30 of this code may be filed in writing by any property owner or their agent with the community <br />31 development director within thirty (30) days after the making of the order or decision being <br />32 appealed. <br />33 <br />34 An appeal stays all proceedings and the furtherance of the action being appealed unless it is <br />35 certified to the board of adjustment and appeals, after the notice of appeal is filed, that by reason <br />36 of facts stated in the certificate a stay would cause imminent peril to life and property. In such <br />37 case, the proceedings shall not be stayed other than by a restraining order that may be granted by <br />38 a court of record on application, and upon subsequent notice to the city. <br />39 <br />40 The written appeal shall state the specific grounds upon which the appeal is made, and shall be <br />.41 ' accompanied by a fee established by resolution of the city counciL A hearing regarding the <br />42 matter shall be held before the planning commission Board of Adjustment and Appeal at its next <br />43 regular meeting consistent with the notice requirements and other procedures contained in <br />44 chapter 108 of this code. <br />45 <br /> <br /> <br /> <br />1 <br />
