Purpose: The RoseviIle City Code, Title 10, Sections 1014, 12 Subsectionl014.04 is hereby amended by revising language regarding the designation and 13 operation for the City of RoseviIle Board of Adjustment and Appeals to allow for more 14 efficient use of the Planning Commission and City Council meetings, by creating 15 designating a Variance Board and designating three members Planning Commission to 16 serve as such Board. :; V~SECTION 2. CHAPTER 1014.04 is hereby amended to read as follows: t!af2;ti 19 20 /1014.04: BOARD OF ZONING ADJUSTMENTS AND APPE : 21 . The city council shall annuall desi nate three members of the Plannin ommission to act as, 22 "the. Board of Zoning Adjustments and Appeals pursuant to Minneso tatutes Chapter 462. 23 Requests for variances, . shall be processed by the 24 community development director or his or her designee in accordance with the provisions of 25 chapter 1013 of this title or other relevant section of this code and Minnesota Statutes 15.99. 26 27 An appeal from the ruling of the Community Development Director or his/her designee 28 regarding any interpretation of the legislative intent of this title or title 11 of this code, or any 29 action approving or denying an application related to any matter addressed in this title or title 11 30 of this code may be filed in writing by any property owner or their agent with the community 31 development director within thirty (30) days after the making of the order or decision being 32 appealed. 33 34 An appeal stays all proceedings and the furtherance of the action being appealed unless it is 35 certified to the board of adjustment and appeals, after the notice of appeal is filed, that by reason 36 of facts stated in the certificate a stay would cause imminent peril to life and property. In such 37 case, the proceedings shall not be stayed other than by a restraining order that may be granted by 38 a court of record on application, and upon subsequent notice to the city. 39 40 The written appeal shall state the specific grounds upon which the appeal is made, and shall be .41 ' accompanied by a fee established by resolution of the city counciL A hearing regarding the 42 matter shall be held before the planning commission Board of Adjustment and Appeal at its next 43 regular meeting consistent with the notice requirements and other procedures contained in 44 chapter 108 of this code. 45 1
