<br /> <br /> <br />Community Development Department <br />651-490-2279 . fax: 651-490-2931 <br /> <br />December 2, 2003 <br /> <br />Mr. James Badzinski <br />385 South Owasso Boulevard <br />Roseville, MN 55113 <br /> <br />RE: Approved Setback Permitfor 381 South Owasso Boulevard, PF3540. <br /> <br />Dear Mr. Badzinski: <br /> <br />On Tuesday November 25,2003, the Development Review Committee held the hearing <br />regarding your request for a 2 foot Setback Permit to allow for the reconstruction of a detached <br />accessory building (garage) that encroaches into the required 5 foot side yard setback. <br /> <br />Members of the DRC reviewed your proposal and concluded that the request met the purpose <br />and intent of the Setback Permit process and recommended that the 2 foot encroachment into the <br />required 5 foot side yard setback be approved. <br /> <br />The purpose of this letter is to inform you that I concur with the reasoning set forth by the DRC <br />and have approved your Setback Pennit. I also concur with the DRC conditions attached to the <br />Setback Permit, which conditions are as follows: <br /> <br />)> That gutters be installed to direct roof drainage via down spouts into the yard area <br />that lies between the home and detached accessory building; specifIcally directing <br />runoff in a northeasterly direction. <br /> <br />)> That the roof trusses be designed with a maximum overhang of 12 inches. <br /> <br />)> The location of the property corner pins be clearly marked allowing the verification <br />of a proper foundation setback from the side yard property line, prior to the <br />issuance of the actual building permit. <br /> <br />The Setback Permit process has a mandatory 10-day appeal time line that affords you and/or <br />adjoining property owners the ability to appeal our decision regarding your application request <br />and any conditions placed on said request. In the case of your request, you own both 385 and <br />381 South Owasso Boulevard (two of the three properties notified). The City Planner discussed <br />your intentions with the property owner at 375 South Owasso Boulevard (the third resident <br />noticed) where they indicated support for your request and a desire not to appeal our decision. <br />Given these factors, the appeal time line has been waived. <br /> <br />2660 Civic Center Drive .:.
