<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 15th day of December, 2003, at 6:30 <br />p.m. <br /> <br />The following members were present: Kough, Maschka, Klausing, Schroeder & <br />Kylysyczyn. <br /> <br />and the following were absent: None <br /> <br />Council Member Kysylyczyn introduced the followi'ng resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10171 <br />A RESOLUTION DENYING A VARIANCE TO SECTION 1004.02D5 OF THE <br />ROSEVILLE CITY CODE FOR DAN NORRIS 1547 SEXTANT AVENUE (PF3541). <br /> <br />WHEREAS, Dan Norris has requested a VARIANCE to Section 1004.02D5 of the <br />Roseville City Code to allow the constmction of an attached garage on to the west side of his <br />existing home; and <br /> <br />WHEREAS, the Norris parcel is located at 1547 Sextant Avenue, and legally described <br /> <br />as: <br /> <br />Part of Lot 4, Block 4, and all of Lot 5, Block 4, Verde Haven. <br />PIN: 10-29-23-23-0063 <br /> <br />WHEREAS, Section 1004.02D5 (Dwelling Dimensions - Rear Yard Setback) requires a <br />minimum rear yard setback of 30 feet; and <br /> <br />WHEREAS, Mr. Norris seeks approval to encroach 18 feet into the required rear yard <br />setback; and <br /> <br />WHEREAS, the Roseville Planning Conmlission held the public hearing regarding the <br />Norris request on December 3, 2003, recommending (7-0) to DENY the request based on the <br />following findings: <br /> <br />a. The property can be put to a reasonable use under the official controls of the City <br />of Roseville, without a variance. <br /> <br />b. The plight of the property owner is due to his interest in constructing an oversized <br />attached garage that encroached into the required rear yard setback. <br /> <br />1 <br />
