<br />5.2 Section 1004.02D5 requires a 30 foot minimum rear yard setback. The Norris principal <br />currently lies just over 21 feet from the north (rear) property line. The proposed by <br />Mr. Norris seeks the ability to construct an attached garage 12 feet from the north <br />property line or an 18 foot variance. The Planning Commission did not support a <br />variance to this section of the City Code. <br /> <br />5.3 Although the proposed attached garage is very large, its size is permitted under the City <br />Code (size allowed up to footprint size of principal structure or 1,699 sq. ft and ability to <br />meet impervious coverage maximum of30% or 4,491 sq. ft.). That being said, other <br />sections of the City Code such as setback requirements can regulate structure size, unless <br />variances are granted. <br /> <br />5.4 The original west lot line (prior to the frontage road construction in 1988) would have <br />been considered an interior lot side yard with a 5 foot setback applied. However, access <br />to any proposed enlarged garage on the parcel prior to the frontage road would have had <br />to come from Sextant Avenue (the frontage raid was build well after the home). The <br />proposal by Mr. Norris would place an attached garage 8 feet from the west property line, <br />requiring a 22 foot variance. <br /> <br />5.5 The principal structure was also constructed prior to the adoption of a City zoning <br />ordinance, which now requires a rear yard setback minimum of 30 feet. The rear yard is <br />determined to be the north property line, for which the existing house lies just over 21 <br />feet or encroached 9 feet. The proposal by Mr. Norris would place the new attached <br />garage 12 feet from the rear property line, requiring an 18 foot variance. <br /> <br />5.5 The driveway proposed by Mr. Norris at roughly 60 feet wide is much larger in width <br />than the 26 foot residential maximum allowed by the Roseville City Code. Staff does not <br />support this width, nor a variance to increase the Norris driveway within the right-of-way <br />larger that the 26 maximum width. Staff does support the creation of two separate <br />accesses (aprons and short driveways). Further, staff does not support a variance to <br />Section 602.06 of the Roseville City Code to allow the parking of vehicles in the city <br />boulevard. <br /> <br />5.6 The City Planner has reviewed the development proposal with regard to variance <br />standards and detemlined that it is difficult to justify a departure from the strict <br />application of the City Code allowing the applicant to construct the proposed attached <br />garage. However, there is justification for reducing the size of the replacement garage to <br />a size 26 feet by 52 feet or 1,352 sq. ft. <br /> <br />5.7 Specifically, the existing principal structure has a 21 + foot rear yard setback. Requiring <br />or limiting the attached garage to this same setback as the principal structure and <br />allowing the attached garage to be constructed at the Code allowed 27 foot front yard <br />setback, would reduce the structure from 60 feet to 52 feet. <br /> <br />PF3541 - ReA 121503 - Page 3 of7 <br />
