Additional area standards and requirements for commercial districts. The following requirements are in addition to <br />those in subparagraph A above. Where there may be a conflict, those requirements under this subparagraph shall prevail: <br /> <br />1. Front setbacks--Prevailing. Where adjoining structures existing on the effective date of this chapter have a <br />different setback from that required, the front setback of a new structure shall conform to the prevailing setback in <br />the immediate vicinity. The chief building official shall determine the necessary front yard setback in such cases. <br /> <br />2. Side and rear setbacks--Party walls. Buildings may be excluded from side and rear setback requirements if <br />walls are used and if the adjacent buildings are constructed as an integral structure. This shall not permit <br />structures closer to residential districts, however, than required under subparagraph A above. <br /> <br />Height. Buildings or structures in excess of the maximum height limitations imposed by subparagraph A <br />above may be allowed as conditional uses as defined in section 11.03, subject to the following conditions: <br /> <br />The height of buildings or structures in commercial and industrial districts shall be as approved by <br />city except as regulated in air traffic corridors. <br /> <br />The front setbacks shall not be less than three-fourths of the height of the building or structure. The <br />rear and side setbacks shall not be less than one-half of the height of the building. <br /> <br />(c) The maximum required green area for the buildings or structures over three stories shall be 60 feet <br />the front and 25 feet on the side and rear yards. The green area shall be increased from the present <br />green area requirements in commercial and industrial districts by five feet per story on the front, side and <br />rear yards until the maximum required green area has been obtained. <br /> <br />Guest parking only may be allowed on the front side of the building or structure, and number of <br />guest parking spaces shall be determined by the council. <br /> <br />Parking shall not be allowed adjacent to any side of such a building or structure in order to provide <br />lanes and adequate fire protection for the building or structure. <br /> <br />(f) The front side of the building or structure shall be determined by the applicant. The front yard shall <br />consist of the area between the designated front side and the lot lines on said side bounded by parallel <br />lines extending from the approximate corners of the designated side to the lot line(s). <br /> <br />(g) A permit for a building or structure in excess of the normal maximum height limitations shall not be <br />allowed if the building or structure is located less than 300 feet from a single-family residential district as <br />measured from the nearest point of such building or structure to the nearest point of the residential <br />district. <br /> <br />(h) Special review and consideration will be given to proposed buildings or structures that take <br />advantage of significant topographical changes in elevations that would minimize the impact of the <br />structures top floor elevation in relation to single-family residential dwellings in the area. <br /> <br />http://livepublish.municode.com/13/Ipext.dllllnfobase43/11de 111 090?f=templates&fn=document- frame.h... 01/1712003 <br />
