They are accepting our $60,000 offer with certain <br />conditions. My thoughts on those conditions are as follows: <br /> <br />1. Parking spaces. They want confirnlation from the City building inspector that <br />there will be sufficient parking spaces in light of the revised legal description. I assume that <br />the City will not have a problem with this request. <br /> <br />2. Sewer easement encroachment. They want an assurance that the City will not <br />force removal of the apartment building because it encroaches on the existing sewer easement. <br />While this easement is currently in the City's name, it really belongs to the Metropolitan <br />Council. As you can see in the attached letter from Jeanne Matross, the Council wants to get <br />the easement into the Council's name. This issue, therefore, really does not involve the City, <br />and in any event, it is separate from the condemnation action. I propose that we tell Mr. <br />Garley to talk to the Metropolitan Council about his concerns. <br /> <br />3. Setback violation. When Mr. Garley obtained a survey of his property recently <br />(copy enclosed), it shows an encroachment on the five foot setback at the rear of the garage. <br />
