<br />CONSENT TO ENTER <br />AND <br />WAIVER OF TRESPASS AGREEMENT <br /> <br />TREGO LIMITED PARTNERSHIP (Owner), being the record owner of that certain <br /> <br />real estate, described below, located in Ramsey County, Milmesota, hereby consents to allowing the <br /> <br />CITY OF ROSEVILLE, a municipal corporation (City), and its duly authorized agents to enter <br /> <br />upon said property for the purpose of completing the construction ofthe extension ofTen-ace Drive, <br /> <br />including the installation of underground utilities, said construction to be along and upon the <br /> <br />following described real estate, to-wit: <br /> <br />The South 35 feet of Lot 1, Block 2, Hamlille Court, Ramsey County, <br />Minnesota. <br /> <br />Owner covenants that it is the owner of the above described real estate and has the <br /> <br />authority to, and does in fact, consent to the City's entry. <br /> <br />The City shall have the right to clear the above-described property of all structures, <br /> <br />fences, trees, slmlbbery, undergrowth and other obshl.lctions that may interfere with or endanger the <br /> <br />road construction process, and to othelwise undeliake whatever actions that are typically and <br /> <br />reasonably necessary to install underground utilities and construct a roadway. <br /> <br />It is specifically understood and agreed that the above-named record owner has not <br /> <br />received consideration for the above-described right to enter and does not \vaive the right to receive <br /> <br />full and adequate consideration for the granting ofthe necessary pennanent and/or temporary <br /> <br />easements required for this improvement. The purpose of this Agreement is to allow construction at <br /> <br />the earliest possible time, and the above-named record owner specifically reserves the light to make <br /> <br />all claims necessary for damages which may be incurred as a result ofthe construction; and it may <br /> <br />be necessary that the determination of such damages would be made by means of the necessary <br /> <br />eminent domain proceedings. The above-named record owner expressly waives any claims of <br /> <br />trespass which it may othelwise have over and across the propeliy above-described by the City. <br />
