The letter and <br />discussions concerned two issues: parking and severance damages. Upon further review, the <br />City proposes the following in order to resolve this matter without the cost of a condemnation <br />proceeding. <br /> <br />Parking. You indicated that, following the taking, the property will have a total of 181- <br />183 stalls, which is less than the 190 stalls required by the zoning ordinance. You had <br />proposed that the City either obtain additional land for parking or simply pay the owner the lost <br />value of the parking. <br /> <br />The City had a code inspector review the parking lots. He found 96 indoor stalls and 94 <br />to 95 outdoor stalls, which totals 190 or 191. The outdoor stalls include the 83 stalls that are <br />currently marked and 11 or 12 unmarked stalls along the southern edge of the parking lot. To <br />the extent that those unmarked stalls are too close to the street right-of-way under the zoning <br />ordinance, the easement will be reduced in width from the current 35 feet. This will allow the <br />unmarked stalls to be properly utilized. The parking will then be in compliance with the <br />zoning ordinance and no compensation is warranted. <br />
