<br />7 Your block of Dunlap has a minimum front yard setback requirement (Section 1004.02E) <br />of 40 feet from the front property line. The current code requirement for most parcels in <br />Roseville and any new parcels created is a 30 foot setback (Section 1004.02D5) from the <br />front property line. <br /> <br />8 Staff considers your block of Dunlap to have irregular differences in setback depth <br />because there is no true standard. Almost every home constructed on the block has a <br />different setback. <br /> <br />9 The construction of a detached accessory structure (double or triple) would more than <br />likely require a variance to Section 1004.02A6, Maximum Total Surface Area. <br /> <br />10 Section 4.8 makes the assumption that the existing garage will be reused as a workshop. <br />Unfortunately this assumption was made in error. The garage will be replaced. <br /> <br />11 The addition will be approximately 50 feet long from east to west, with multiple <br />windows. The garage is only 24 feet in depth. The addition would extend 24 feet <br />forward from the existing home, which is the approximate distance forward from your <br />home. <br /> <br />12 The Roseville City Code only requires enforcement of a front yard setback from a <br />distance of 40 feet, regardless of the distance a home or homes are setback. Specifically, <br />in the case of the homes in your general vicinity, all have a predominant setback <br />established at the current distance the homes lies from the front property line, but the City <br />Code is only enforceable from 40 feet. Section 4.1 of the report states what is required <br />under the Code language. <br /> <br />13 A setback permit is an administrative variance that requires notification of neighbors <br />directly adjacent to and/or impacted by an improvement request and an administrative <br />hearing. A setback permit is required to meet certain criteria, reviewed by staff, for <br />approval to be granted. Conditions can and usually are placed on all setback permits <br />issued by the City. This process, because it is administrative, takes approximately three <br />weeks. A variance requires the proof of a hardship, unique circumstance, and or <br />characteristic. The term "hardship" or "undue hardship" typically refers to physical <br />characteristics of the property, such as shape, soil conditions, or extreme topography. <br />Neither mere inconvenience, nor reduction in value alone, is sufficient to justify a <br />variance. The inability to put property to its highest and best use is not considered a <br />hardship or practical difficulty. The problem that justifies the variance must be caused by <br />conditions beyond the control of the applicant. The applicant cannot create the condition <br />that requires the variance. <br />
