B. The plight of the landowner is due to circumstances unique to the property not
created by the landowner: The Bean property (site/structure) is unique. It was
constructed before the Village/City established a zoning code and was placed in a
location that affords limited growth options. Family needs and designs of homes
and lots have dramatically changed in the past six decades, and in so doing have
created certain conflicts with established codes of older communities. The
Community Development Staff has determined that the plight of the
landowner is due to circumstances unique to the property not created by the
landowner.

C. The variance, ifgranted, will not alter the essential character of the locality:
The improvements proposed though not a standard feature of a 1940' s home are
standard in today's society. Specifically, a high percentage of homes built today
include larger living, kitchen, dining and bedroom areas for family and guest
gathering/socializing. The design proposed for the Bean's home will not be out of
character or context of a home from 1940's and more importantly in keeping with
today's designs and family accommodations. The Community Development
Staff has determined that this variance, if granted, will not alter the essential
character of the locality, nor adversely affect the public health, safety, or
general welfare, of the city or adjacent properties.

6.0 STAFF RECOMMENDATION:

6.1 Based on the information provided and the findings in Section 5 of this proj ect report, the
Community Development Staff recommends approval of a 24 foot VARIANCE to Section
1004.0lE and a 2 foot VARIANCE to Section 1004.02D5 of the Roseville City Code for
Brian Bean to allow the construction a living area addition on to the west side of the
existing home and a garage addition on to south of the home at 1760 Dunlap Street,
subject to the following conditions:

A. The proposed side yard addition (north) being limited to an encroachment of two
feet or to a point three feet from the property line.

B. The proposed front yard addition (west - attached garage) being limited to an
encroachment of 24 feet or to a point 24 feet from the front yard property line.

C. The additions must match or be of similar to that of the existing building in color
and/or materials.

D. Gutters and downspouts being placed along the eve of the additions were
appropriate to properly direct roof drainage onto the subject parcel and away from
neighboring properties.

PF3459 - RPCA 040203 - Page 5 of 6
