<br />3.0 PUD APPROVAL <br /> <br />The CITY hereby grants approval of the Planned Unit Development (identified as <br />ExhibitsA through N in Section 4 of this Agreement), subject to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits, if said applications are consistent with the plans <br />identified in Section 4.0 below. <br /> <br />For any improvements not contemplated in this Agreement, the CITY may require <br />compliance with any amendments to the Comprehensive Guide Plan, official controls, <br />platting or dedication requirements enacted after the date of this Agreement. <br /> <br />4.0 APPROV AL by the CITY <br /> <br />The CITY hereby approves the following plans on file with the City. The DEVELOPER <br />shall develop the subject property in accordance with these plans. If, however, the plans <br />are inconsistent with the written terms of this Agreement, the written terms of this <br />Agreement shall control. If the plans address items not specifically addressed in this <br />Agreement, the plans shall govern with respect to those items. The plans are: <br /> <br />Exhibit A <br /> <br />Exhibit B <br /> <br />Exhibit C <br /> <br />Exhibit D <br /> <br />Exhibit E <br /> <br />Exhibit F <br /> <br />Certificate of Survey/Subdivision Plat of Good Samaritan First Addition <br />based on preliminary plat dated May 8,2003 and ALTA Survey dated <br />May 8, 2003. <br /> <br />Site development plan that includes property boundary, building setbacks, <br />structure location (including the trash enclosure), curbing, and parking <br />setbacks (each individual development project), Drawing No. C-2 dated <br />May 8,2003. <br /> <br />Grading plan illustrating existing grades and those proposed after <br />completion of the proposed construction, drainage directions, spot <br />elevations, catch basins for surface water catchment, and the erosion <br />control plan, Drawing No. C-I through C-3 dated May 8, 2003. <br /> <br />Sanitary sewer and water plan illustrating all connections, pipe sized, line <br />locations, manhole locations, hydrant locations, and other applicable <br />utility plan information, Drawing No. C-2 and C-3, dated May 8,2003. <br /> <br />Master dedication and easement plan illustrating all street, trails, utility <br />and other conveyances, dedications, and easements to the CITY necessary <br />for utility services, access, and parking as shown on Preliminary Plat, <br />dated ,2003, and Final Plat dated July _,2003. <br /> <br />Landscape plan including materials list, sizes, and locations of all plant <br /> <br />2 <br />
