J. <br /> <br />Department Approval: <br />DPW <br /> <br />Ci1 Manager ,r <br />'./ll!/I(l ";':)eJ::M) <br /> <br />Request for approval of restaurant outdoor patio food/liquor locations. <br />01 'Mexico, 1754 Lexington; Outback Steak House 2181 Snelling <br /> <br />Agenda Section: <br /> <br />Item Description: <br /> <br />1.0 REQUESTED ACTION: <br /> <br />1.1 01' Mexico Restaurant (John Pavlik) 1754 North Lexington Avenue and Outback Steak <br />House (Diane KiImey),2181 North Snelling Avenue have requested Council approval to <br />establish and use outdoor patios to serve food and intoxicating beverages. Both <br />businesses hold liquor licenses. <br /> <br />1.2 The uses listed above are permitted uses in B-2 (Retail Business) and B-3 (General <br />Business) zoning districts, respectively. Both operations have leased off-site (but nearby) <br />parking presumably for their employees, and parking is adequate to serve the additional <br />customer capacity. <br /> <br />1.3 The City Code states that a license is required to serve intoxicating beverages. In addition <br />Section 302.11 states that sales uutside of the structure requires permission of the City <br />Council; the fee is $25.00 and written notice must be sent to adjacent property owners. <br />(Staff has sent notice and this staffreport to adjacent property owners.) <br /> <br />1.4 The Council may approve or deny, or add conditions to the approval such as screening, <br />noise limitations, and hours of operation. <br /> <br />2.0 RECOMMENDATIONS: <br /> <br />2.1 Receive any comments from adjacent property owners, <br /> <br />2.2 The Community Development Staff recommends approval subject to conditions. <br />a. Screen all light from adjoining residential districts. All lighting to be down cast. <br />b. No outdoor music after 10 pm on sites adjacent to residential districts. <br />c. Patio to be completely fenced in, with entry from the main building, but the <br />fenced in area to include emergency exits. Patio must be entirely on business's <br />property; no roof extensions or canvass type patio roofs closer than 30 feet to <br />property line. <br />d. No ground mounted signage on the patio or attached to fencing, No ground <br />mounted signage closer than 15 feet to property lines. , <br />e. No food or beverages served after lOpm on sites adjacent to residential districts. <br />f. Restaurant to provide approval letter for outdoor patio food/liquor sales from <br /> <br />1 <br />
