A. <br /> <br />Department Approval: <br />DPW <br /> <br />Item Description: <br /> <br />City Manager <br />/1P/U 6L~ <br /> <br />. <br />Request for approval of restaurant outdoor patio food/liquor locations. <br />OI'Mexico, 1754 Lexington <br /> <br />Agenda Section: <br />CONSENT <br /> <br />On March 31, 2003, The Council continued the discussion and action on the 01' Mexico <br />outdoor Patio food and liquor sales to allow for a meeting with neighbors. The neighbors <br />met with OI'Mexico operators and staff on April3, 2003, and resolved their concerns. The <br />recommendations listed in Section 2.2 include the conditions recommended (and agreed to) <br />by all parties. <br /> <br />1.0 REQUESTED ACTION: <br /> <br />1.1 01' Mexico Restaurant (John Pavlik) 1754 North Lexington Avenue has requested <br />Council approval to establish and use outdoor patios to serve food and intoxicating <br />beverages. Both businesses hold liquor licenses. <br /> <br />1.2 The use listed above is a permitted use in B-2 (Retail Business) zoning district. aI' <br />Mexico has leased off-site (but nearby) parking presumably for their employees, and <br />parking is adequate to serve the additional customer capacity. <br /> <br />1.3 The City Code states that a license is required to serve intoxicating beverages. In addition <br />Section 302.11 states that sales outside of the structure requires permission of the City <br />Council; the fee is $25.00 and written notice must be sent to adiacent property owners. <br />(Staff has sent notice and this staff report to adiacent property owners.) <br /> <br />1.4 The Council may approve or deny, or add conditions to the approval such as screening, <br />noise limitations, and hours of operation. <br /> <br />Next Page <br /> <br />1 <br />
