<br />5. Additional Parking for 011 Mexico. <br /> <br />The Developers agree to provide parking spaces for 01' <br />Mexico in accordance with a certain License Agreement dated <br />Oct9ber 3, 1979, and amendatory Letter dated May 29, 1986, copies <br />of which License A reement and Letter are attached hereto <br />respectively as <br /> <br /> <br />6. Traffic Conditions. <br /> <br />The Developers agree to cooperate with Ramsey County and <br />the City's engineering staff to investigate traffic conditions of <br />Lexington Avenue in the area in close proximity to the Existing <br />Development and the Project. The investigation shall include, if <br />required by the City, an independent traffic analysis the costs <br />of which shall be paid for by the Developers. <br /> <br />7. Grading and Lighting. <br /> <br />The grading and lighting plans for the Project shall be <br />approv8d oy the City Staff and shall be consistent with the <br />previously approved grading and lighting plans for the Existing <br />Development. <br /> <br />8. Trash Collectors. <br /> <br />The recepticles for trash collection for the project <br />shall be enclosed, covered and screened from the view of the area <br />residents. <br /> <br />9. General. <br /> <br />(a) The Developers shall obtain such permits, licenses, <br />and other authorizations as may be required for the commencement <br />and completion of the project and shall comply with all applic- <br />able laws, ordinances, and rules and regulations of City and any <br />federal, state, and local governmental body. Nothing in this <br />Agreement is intended to waive or modify the requirements and <br />provisions of any applicable building code or City ordinances. <br /> <br />(b) Plaza Shoppes Associates shall indemnify, hold harm- <br />less and defend City, its officers, agents and employees from any <br />claims, damages, or liability of any kind arising out of, inciden- <br />tal to, or in connection with the use, nonuse ownership, condi- <br />tion, or construction of the Project or any part thereof, whether <br />or not due to the negligence of the Developers or any contractor <br />or its or their employees, servants or agents, except for lia- <br />bility arising out of the sole negligence of City, its officers, <br />agents or employees. Plaza Shoppes Associates' liability <br />hereunder shall not be limited to the extent of insurance carried <br />by or provided by it nor subject to any exclusions from coverage <br />in any insurance policy. . <br /> <br />~ <br /> <br />5 <br />
