<br />2.0 RECOMMENDATIONS: <br /> <br />2.1 Receive any comments from adiacent property owners. <br />Underlined items listed below where added after the neighbors meeting on 4/3/03. <br /> <br />2.2 The Community Development Staff recommends approval subject to conditions. <br />a. 01 Mexico will build a patio only within the grassed area along the north side of <br />the building in an area described as: west of the double doors on the north wall of <br />the building and setback at least one foot from all existing sidewalks surrounding <br />the patio. A wrought iron fence five feet in height will be install surrounding the <br />entire patio area. 01' Mexico will plant arbor vitae or other vegetation to screen <br />the patio area on the west, north and east side, except where two 36" (or larger) <br />exit doors with panic hardware must be installed. The required exit doors will be <br />covered with canvas. The fire water connections on the side of the building must <br />not be inside the fenced patio area, and must be clearly visible form the northwest <br />and north side of the building. 01' Mexico must install an exterior horn and light <br />to alert fireman of the location. A licensed electrical contractor must install such <br />devices, after receiving an electrical permit from the City. <br />b. The maximum number of tables (with umbrellas) will be 15 to 20 on the patio at <br />any time. <br />c. Deliveries to the restaurant will be done after 7am and before 4:30 pm. <br />d. Garbage pick-up will be done after 7am and before 4:30 pm. <br />e. Employees of the restaurant will not be allowed to park behind the building or <br />within the signed fire lanes. Ol'Mexico will post Fire Lane-No Parking signs at <br />least once every 100 feet on both sides of the alley behind their premise. The <br />shopping center manager will post Fire Lane-No Parking signs at least once every <br />100 feet on both sides of the alley for the length of the Center. <br />f. Screen all light from adjoining residential districts. All lighting to be down cast. <br />Lighting along the alley and back wall (east side) of the restaurant will be <br />corrected to shine down, instead of east into the adioining neighbors lots - as <br />required by City Code. <br />g. No outdoor music after 10 pm on sites adjacent to residential districts. <br />h. Patio to be completely fenced in, with entry from the main building, but the <br />fenced in area to include emergency exits. Patio must be entirely on business's <br />property; no roof extensions or canvass type patio roofs closer than 30 feet to <br />property line. <br />1. No ground mounted signage on the patio or attached to fencing. No ground <br />mounted signage closer than 15 feet to property lines. <br />J. No food or beverages served after 9:30pm on sites adjacent to residential districts. <br />The patio will be vacated and closed to all customers by 10:00 pm each night. The <br />patio will be signed to alert customers to this fact. <br />k. Restaurant to provide approval letter for outdoor patio food/liquor sales from <br />shopping center property owners or managers prior to issuance of building, county <br />health, or other permits as per application site plan. <br />1.
