<br />1 Proof of Parking Agreement <br />2 <br />3 THIS AGREEMENT, Made and entered into this _day of <br />4 20_, by and between , a <br />5 ("Grantee") and CITY OF <br />6 ROSEVILLE, a Minnesota municipal corporation (the "City); <br />7 <br />8 A. Grantee is the fee owner of certain real property ("Property") located in the <br />9 City of Roseville, County of Ramsey, State of Minnesota, legally described on Exhibit A <br />10 attached hereto and hereby made a part hereof; and <br />11 <br />12 B. Grantee proposes to <br />13 ("Project"), which is to include parking and landscaping to be used in connection <br />14 therewith (the Project and said parking and landscaping being hereinafter called the <br />15 "Improvements"); and <br />16 <br />17 C. The Property currently has (_) parking spaces on <br />18 site but would need (_) parking spaces, following <br />19 completion of the proposed Project, to comply with the City's zoning ordinances; and <br />20 <br />21 D. Grantee has submitted to the City a parking plan prepared by <br />22 dated ,20_ ("Plan"), which Plan provides <br />23 for a total of _ parking spaces, in compliance with City code requirements, to be <br />24 constructed on the Property; a copy of which Plan is on file with the City and which Plan <br />25 is incorporated herein by reference; and <br />26 <br />27 E. Grantee is of the opinion that _ parking spaces are not required for the <br />28 operation of the Project and Improvements, and has requested from the City Council a <br />29 temporary parking variance allowing the construction of the proposed Project with <br />30 additional parking spaces being added only if needed in the future; and <br />31 <br />32 F. The City did, on ,20_, in Planning File No. <br />33 grant the requested variance because strict enforcement of the City Code would, in this <br />34 case, cause undue hardship because of circumstances unique to the Property, and the <br />35 grant of such variances has been determined by the City to be in keeping with the spirit <br />36 and intent of the applicable ordinances, but the parking variance was temporary only and <br />37 was conditioned upon the execution, delivery, and recording of this Agreement, and upon <br />38 the conditions hereinafter set out in this Agreement, which the City deems necessary to <br />39 impose to ensure compliance with the applicable City ordinances and to protect adjacent <br />40 properties; and <br />41 <br />42 G. Grantee is agreeable to the granting of the temporary parking variance <br />43 subject to the conditions hereinafter set out, and is willing, and represents that it has the <br />44 power and authority, to enter into this Agreement; and <br />45 <br /> <br />1 <br />
