<br />1 (d) Withhold, deny, or revoke any building permits, certificates of occupancy, <br />2 utility connection permits and any other permits and approvals, issued or granted by the <br />3 City for the construction or occupancy of all or any part of the Improvements, until such <br />4 failure or refusal ends and the Grantee fully complies with its obligations hereunder. <br />5 <br />6 All of the foregoing remedies shall be usable and enforceable by the City <br />7 separately or concurrently as the City shall determine, and the use of one remedy shall <br />8 not waive or preclude the use of any or more of the other remedies. Also, the failure to <br />9 exercise, or delay in exercising, any remedy hereunder in the event of a failure or refusal <br />10 by Grantee, shall not preclude the City from thereafter exercising any of its remedies for <br />11 the same or a subsequent failure or refusal. Grantee agrees to pay to the City any and all <br />12 costs and expenses incurred by the City in enforcing this Agreement by the use of the <br />13 remedies above set out or by other remedies or means available to the City at law or in <br />14 equity, including attorneys' fees whether suit be brought or not, and with interest on all <br />15 such costs and expenses at the rate established by the City and allowed by law from the <br />16 dates incurred by the City until paid. <br />17 <br />18 Grantee also aggress to pay all costs of collection of any monies due to the City <br />19 from Grantee pursuant hereto, and of such costs and expenses incurred in enforcing this <br />20 Agreement, with interest thereon, again including attorneys' fees and whether suit be <br />21 brought or not, with interest from the dates such costs of collection were incurred until <br />22 paid. <br />23 5. All notices, reports, or demands required or permitted to be given under this <br />24 Agreement shall be in writing and shall be deemed to be given when personally delivered <br />25 to any officer of the party to which notice is being given, or when deposited in the United <br />26 States mail in a sealed envelope, with registered or certified mail postage prepaid thereon, <br />27 addressed to the parties at the following addresses; <br />28 To the City: City Manager <br />29 City of Roseville <br />30 2660 Civic Center Drive <br />31 Roseville, MN 55113 <br />32 <br />33 <br />34 <br />35 To Grantee: <br />36 <br />37 <br />38 <br />39 Such addresses may be changed by any party upon notice to the other party given as <br />40 herein provided. <br />41 <br />42 6. The terms and provisions hereof shall be binding upon and inure to the benefit <br />43 of the parties hereto and their respective successors and assigns, and shall run with the <br />44 title to the Property and be binding upon all present and future owners of the Property. If, <br />45 for any reason, the provisions hereof should be determined by the legal counsel for the <br />46 City, or by a court of competent jurisdiction, not to be binding upon and fully enforceable <br /> <br />4 <br />
