Up to fifty percent (50%) of the parking facilities required for a church or for <br />an auditorium incidental to a public or parochial school may be supplied by <br />the off-street parking facilities provided by uses specified in subsection 4 <br />below as primarily daytime uses. (1005.0JE2c) <br /> <br />4. For the purposes of this subsection, the following uses are considered as <br />primarily daytime uses: Banks, business offices, retail stores, personal service <br />shops, household equipment or furniture shops, clothing or shoe repair or <br />service shops, manufacturing, wholesale and similar uses. (J005.0JE2d) <br /> <br />5. Conditions Required For Joint Use: <br /> <br />a. The building or use for which application is being made to utilize the off- <br />street parking facilities provided by another building or use shall be <br />located within four hundred feet (400') of such parking facilities. <br />(J 005. OJE2e(J)) <br /> <br />b. The applicant shall show that there is not substantial conflict in principal <br />operating hours of the two (2) buildings or uses for which joint use of off- <br />street parking facilities is proposed. (J005.0JE2e(2)) <br /> <br />c. A properly drawn legal instrument, executed by the parties concerned for <br />joint use of off-street parking facilities, duly approved as to form and <br />manner of execution by the City Attorney, shall be filed with the City <br />Manager. (J005.0JE2e(3)) <br /> <br />Section 1018.11. Special Parking Provisions or Districts <br /> <br />A. Van Pooling Programs; Reduction Of Parking Spaces Required: Where a van <br />pooling program exists for employees of a user of property in a business district <br />and such program reduces the need for parking spaces, the number of parking <br />spaces not needed because of such program may be reduced from the <br />requirements. Space sufficient to accommodate such reduced number of parking <br />spaces shall be maintained as open space and shall be converted to parking spaces <br />in the event that the program is terminated or its effectiveness in reducing parking <br />space needs drops. Approval and continuation of such reduced parking space plan <br />shall be made by the Community Development Director. (J005.0JD4) <br /> <br />Section 1018.12. Proof of Parking Agreement <br /> <br />A. The City Council may grant Proof of Parking Agreements after hearings and <br />approvals as a condition of a variance or conditional use permit request or as a <br />portion of a Planned Unit Development. Such an agreement shall describe the <br />required parking and reasons for reducing the parking requirement as well as <br />demonstrating that space exists to comply with the most current provisions of the <br />city code.
