<br />Dear Mr Welsch.
<br />
<br />We request an appeal of your setback permit note dated May 27,2003. The note does not ensure the water flow will drain to the
<br />street, not into our yard. Your note discussed the water flow to the street but did not consider water flow from the rear of the
<br />proposed garage.
<br />
<br />Most people are aware, to sell a home you must sign an honest disclosure statement. It gives all buyers the knowledge of any
<br />problems with the home and what was done to fix those problems. We invested approximately $20,000 in our home to fix water
<br />problems in 2001. Since the installation of commercial gutters and drain tile in 2001, we have not had any water problems. Mr
<br />Jordahl's proposed garage, will put our home in jeopardy. We have done everything we can to protect our home from water
<br />damage. Our insurance company has notified us that they will drop our insurance if any further claim occurs in the next 3 years.
<br />Who is willing to act on our behalf, if water flow from the proposed garage causes new water problems on our home?
<br />
<br />We have also reviewed the garages within the Heinel neighborhood and find no houses with garages within 2 feet of the lot line.
<br />The proposed garage is inappropriate for Mr Jordahl's small lot width. We recommend the setback permit be denied due to both
<br />the aesthetic and very real structural/watershed problems.
<br />
<br />In addition, we have reviewed your note dated May 27,2003 and have the following concerns.
<br />
<br />Item a. This item does not address how the back of the garage gutter is drained in a heavy rain. One downspout would be
<br />insufficient to ensure water would not overflow the gutters in a heavy rain. Two downspouts are needed for the 10 by 32-foot
<br />garage, and where does the rear downspout water drain? The garage gutters also will receive water flow from the house roof.
<br />
<br />Item d, following sentence: "The building permit plan for the sidewall of the new garage must include at least two windows or
<br />variation in the type of siding".
<br />
<br />The length of the proposed garage is 32 feet. The Setback Permit Hearing on May 22,2003 discussed two to three windows on the
<br />32-foot exterior wall. The replacement of windows with variation in the type of siding does not break up the starkness of the
<br />exterior wall.
<br />
<br />Item f, statement: There must be a minimum of 12 feet of space between the building wall of your new garage and the adjoining
<br />home wall. This statement is ambiguous and needs clarification.
<br />
<br />SUI-vey: At the setback permit hearing on June nnd, the need for a survey of the lot line was discussed. Your note dated May 27,
<br />does not address the need for an accurate survey of the adjoining lot line.
<br />
<br />We appreciate your review of our concerns with Mr Jordahl's proposed garage. If after the proposed garage is built, water flows
<br />onto our lot in a heavy rain, what happens from a liability standpoint? Who is responsible for fixing the potential water problem?
<br />Who is liable if water damage to our house from the proposed garage causes a loss in our home value?
<br />
<br />It is our conclusion from the setback Permit Hearing of May 22,2003, that Mr Jordahl's Setback Permit will need to be presented
<br />to the Roseville City Council.
