"'~ I <br /> 2800 North 9l.elling Avenoo - <br /> The Planning Canmission at its April 7 ~ lOOeting WlanillDusly recommended approval of <br /> Canadian Financial Corporation's request for rezoning from B-2 to R-3~ special use <br /> ~tmi.t and variance to building height, floor area ratio, lot area and parking at <br /> 800 North Snelling Avenue with the fOllowing conditions: <br /> I <br /> 1. That the total developrrent shall be constructed in accordance With plans I <br /> as submitted by the applicant and approved by the City as prepared by <br /> Winsor, Faricy, Architects, Inc. dated April 7, 1976. <br /> 2. That it specifically be recognized and agreed that the 7 story structure <br /> consisting of 122 tmits are designed ana approved wi th room size standards, <br /> parking accommodatlon and contiguous open space sufficient only for <br /> occupancy by the elderly. At no time should less than 90\ of the occupants, <br /> other than handicapped, be less than 62 years of age. The conditlOn shall <br /> apply regardless of future o-..m.ershlp or change ln rental programs. It is <br /> recognized that the project is approved consistent ~ith a policy deter- <br /> mination that the site plan and specific buildings within it are approved <br /> solely to meet a specialized housing need in the City. <br /> 3. Further delineation of the plans and specifications for site "..arK, buildings <br /> and utilities shall be subject to approval of the Public \'lorks Director. <br /> My major changes 1n plans as approved in thlS special use pennit can be <br /> accomplished only by the processing of a new application and appropriate <br />I public hearing for an a1'lended special use pemi t. <br /> 4. That provisions for meeting the life safety code shall be as approved by <br /> the City Fire Marshal. That the maintenance of all structures, grooods t <br /> utilities, pondin, area and roadl.,rays be the permanent lesponsibility of <br /> the developer and or his assigns. ~bintenance not so accor.plished in a <br /> reasonable mnner shall be done by the C1.ty and assessed against the property. <br /> S.
