The Board or Design Review Committee shall <br />approve or disapprove the request within <br />thirty-five (35) days from receipt by the <br />peraon designated by the As.ociation to <br />receive such requests, or in the ovent of no <br />designation. tho President. In the event the <br />Board of Oirectors or its designated <br />co~ittee fails to approve or disapprove .aid <br />request in writing within thirty-fJve (35) <br />days after said plans and specification have <br />been received by the den!gnated representative <br />of the Association, approval will be <br />automatically given and this Article shall be <br />deemed to have been fully complied with. <br /> <br />4. The Board retains the right to submit any <br />request to the members of the Association at <br />a Special Meeting called in pursuant to the <br />By-Laws. Such meeting shall be called within <br />thirty-f~ve (35) days from receiving the <br />request in accordance with this Article and <br />the request is considered denied until a vote <br />of the member8h~p has been completed. <br /> <br />5. Notice of default of compliance of this <br />~rticle can be given or legal action to <br />enjoin any modification, decoration, change <br />or improvement can be commence~ within <br />thirty-f~ve (35) days of the first reporting <br />of the vlolation to the Board. Approval will <br />be automatically given and this Article shall <br />be deemed to have been fully complied with if <br /> <br />-10- <br />
