Waldron <br />FROM: Rick Jopke <br />SUBJECT: EAW Process <br /> <br />EQB Rules prohibit all governmental units f""olll making a final <br />decision granting any permit or appro\'al nec~ssary to projects <br />until Environmental Review is completed. This prohibition covers <br />preliminary plat approval, conditional use permit, P.U.D. <br />approvals and zoning changeG if the zoning chan~a nequest is for <br />a specific project. Permits can be denied however. <br /> <br />The Can-American project and Brutgers t>roject on the Concordia <br />School site meet the mandatory EAW threshold for residential <br />development. The threshold is 150 or more unattached or 225 or <br />more attached units. Both of the project have a total of mere <br />than 225 attached units. Therefore the city cannot give final <br />approval to these proJects until the environmental review is <br />complete. <br /> <br />I have attached a timeline of the EA'~ process and a timeline <br />showing specific dates whic~ shows it would ~ake ~pproximately 60 <br />days to complete the process if an EAW was co~pleted by <br />August 1, 1988. <br /> <br />As I understand, a petition is or will be c1.rculated in the <br />neighborhood requesting an environmental review. According to <br />EQB Rules, a pet1.tion with onl~' 25 signatures is nccGssary to <br />request an EAW. Th~ City would th~n have to decide whether or <br />not to do an EAW. <br /> <br />
