<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 21st day of October, 2002, at 6:30 <br />p.m. <br /> <br />The following members were present: Kough, Maschka, Klausing, Schroeder, Kysylyczyn <br />and the following were absent: None <br /> <br />Council Member Klausing introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10044 <br />A RESOLUTION APPROVING A VARIANCE TO SECTION 1004.02D4 <br />(SIDE YARD SETBACK ADJACENT TO PUBLIC STREET) AND A VARIANCE TO <br />SECTION 602.06 (PARKING ON BOULEVARD PROHIBITED) OF THE ROSEVILLE <br />CITY CODE FOR PROPERTY LOCATED AT 1275 BURKE AVENUE (pF 3426). <br /> <br />WHEREAS, Michael Strub has requested a variance to Section 1004.02D4 (Side Yard <br />Setback Adjacent to Public Street) in order to construct a detached accessory structure in his rear <br />yard adjacent to Dellwood Avenue; and <br /> <br />WHEREAS, the Strub parcel is located at1275 Burke Avenue and legally described at as: <br /> <br />Lot 16 & 17, Block 1, Midway Hills Rearrangement of Como Garden Lots <br />P¡D Number: 15-29-23-12-0006 <br /> <br />WHEREAS, Section 1004.02D4 limits a comer lot to a setback requirement of 30 feet <br />from each public right-of-way; and <br /> <br />WHEREAS, a variance from Section 602.06 Parking on Boulevard Prohibited) is also <br />necessary in order to allow the parking of a vehicle in front of said accessory building (garage); <br />and <br /> <br />WHEREAS, Michael Strub desires to construct the accessory structure next to his <br />adjacent (north) neighbor in a similar area of the lot to protect the rear yard view and land area <br />and to preserve a minor depression that collects rain water runoff during certain storm events; <br />and <br /> <br />WHEREAS, the placement of the accessory structure would be five feet from the west <br />property line, which required a 25 foot variance from Sections 1004.02D4 and 602.06 of the <br />Roseville City Code; and <br /> <br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />Strub variance request on October 2,2002, and recommended (5-0) approval ofthe request, <br />based on findings outlined in Section 5 and conditions of Section 6 of the project report dated <br />October 2, 2002. <br /> <br />1 <br />
