Dear Mr. Downs: On Wednesday, July 24, 2002, I reviewed your letter clarifying the intent of Synergy Motor Car Company for 1900 Oakcrest Avenue with the City Attorney (Joel Jamnik) and the Community development Director (Dennis Welsch). We have determined that leasing and renting of vehicles is permissible, and that used car sales are permissible if it involves the resale of the previously leased or rented vehicles on the premises. Specifically, Section 1007.02D12 allows this use as a conditional use permit and reads as follows: Rental and leasing of motor vehicles including the resale of motor vehicles previously rented or leased by the leasing or rental business owner. Please not it is clear that used vehicle sales not associated with those rented or leased is not allowed. Section 1007.02Dll of the City Code specifies the requirements of used car sales, which also requires a conditional use permit. Specifically this section reads: Motor Vehicle Dealers: This provision authorizes the sale of new motor vehicles by a motor vehicle dealer and the sale of used motor vehicles by a motor vehicle dealer but only in coniunction with sales of new motor vehicles. The Community Development Staff has determined that it would be difficult for you to obtain a new vehicle dealer license affording you the ability to sell new and used vehicles. In summary, the City of Roseville Community Development Department can support licenses that permit vehicle rental, vehicle leasing, and the resale of those rented/leased vehicles on the premises of 1900 Oakcrest Avenue, Suite 9, but are unable to support a license allowing straight used vehicle sales. 2660 Civic Center Drive .:.
