<br />1 d.Planning File 3427: Request by the City of Roseville to correct (make compliant to <br />2 previous City Council action) the land use designation and zoning of property at 1125 <br />3 Garden Avenue and 1813 Lexington Avenue. <br />4 <br />5 Chair Duncan opened the hearing and requested City Planner Thomas Paschke provide a summary <br />6 of the project report dated September 42002. <br />7 <br />8 The Roseville Planning Staff recently found what appears to be an error in the 1985-1986 original <br />9 document of the City creating a new zoning designation for property located at the northwest <br />10 comer of the intersection of Lexington Avenue and Garden A venue. This may have been done <br />11 because the two legal descriptions became transposed in the documents. In summary here is what <br />12 happened: <br />13 <br />14 At 1813 Lexington Avenue, the owner requested (1985) a "B-1" Limited Business zone and a "B" <br />15 designation on the City's Comprehensive Plan. The legal description for this site was: <br />16 <br />17 "the East 203.07 feet of the South 1/8 of the Northeast 'I. of the South 'I. except the North 67 feet <br />18 of the East 178 feet of the North Y, of the South 'I. of Section 15, Township 29, Range 23". <br />19 (commonly known as 1813 Lexington Avenue) <br />20 <br />21 The original hearing was held on June 5, 1985. The Council held a similar hearing on June 10, <br />22 1985. At that time the legal description was transposed to read in the ordinance as follows: <br />23 <br />24 "the West 125 feet of the East 328.07 feet of the South 165.04 feet of the Northeast y" of the <br />25 Southeast 'I. Section 15, Township 29, Range 23, (subj to ave)". (commonly known as 1125 <br />26 Garden Avenue) <br />27 <br />28 The second description is that of 1125 Garden A venue, which according to city and county current <br />29 records is a single family residential use, zoned for "R-1" Low Density Residential uses and <br />30 shown on the City's Comprehensive Plan as "LD", Low Density Residential. <br />31 <br />32 Staff has discussed this with both property owners. The City can correct this error by <br />33 holding a hearing on a corrective ordinance on October 2,2002 at which time the zoning <br />34 designations would be switched. The "B" Comprehensive Plan designations would be attached to <br />35 1813 Lexington Avenue, and the "LR" Comprehensive Plan designations attached to 1125 Garden <br />36 Avenue. There is no cost to either property owner. <br />37 <br />3 8 Motion: Member Bakeman moved, seconded by Member Duncan to recommend <br />39 approval of Planning File 3427, a corrective ordinance, establishing 1125 Garden Avenue as R-1 <br />40 (Single Family Residential) zoning and a corrective resolution establishing 1125 Garden Avenue <br />41 as LR (Low Density Residential) Comprehensive Plan designation. <br />42 <br />43 Ayes: 5 <br />44 Nays: 0 <br />45 Motion carries. <br />46 <br />47 Motion: Member Bakeman moved, seconded by Member Pepper, to recommend <br />48 approval of Planning File 3427, a corrective ordinance, establishing 1813 Lexington Avenue as B- <br />49 1 (Limited Business) zoning and a corrective resolution establishing 1813 Lexington Avenue as B <br />50 (Business) Comprehensive Plan designation. <br />51 <br />52 Ayes: 5 <br />53 Nays: 0 <br />54 Motion carried. <br />55 <br />56 <br />
