The variance, if granted, will not alter the essential character of the locality: <br />The improvements proposed will create a more functional wetland for this <br />neighborhood; create a aesthetic amenity for the property owners; and afford the <br />parcel owner to construct a home on the parcel in a manner similar to that of the <br />existing neighborhood (and others today). The Community Development Staff <br />has determined that this variance, if granted, will not alter the essential <br />character of the locality, nor adversely affect the public health, safety, or <br />general welfare, of the city or adjacent properties. <br /> <br />6.0 STAFF RECOMMENDATION: <br /> <br />6.1 Based on the information provided and the findings in Section 5 of this project report, <br />staff recommends approval of a 40 foot variance to Section 1016 .16A of the Roseville <br />City Code for Tim & Marcia Brucciani - Horvath to allow construction of a principal <br />structure and attached garage on the vacant parcel along North Gluek Lane, subject to the <br />following conditions: <br /> <br />A Setbacks established for this parcel of: Front Yard - 30 feet; Rear Yard - 30 feet; <br />Interior Side Yard (east) 10 feet; and Wetland Side Yard (west) 10 feet. <br /> <br />B The proposed principal structure and attached home plan being revised to meet <br />the newly established setback requirements indicated above. <br /> <br />C The principal structure meeting the requirements of Section 1016.17 A of the City <br />Code, which may require a lowest floor elevation of three feet above the "new <br />wetland boundary", an item reviewed and approved by the City Engineer. <br /> <br />D The City Planner receiving notice of approval from the Rice Creek Watershed for <br />the proposed wetland revision plan. <br /> <br />E The City Planner and applicants to work with the Rice Creek Watershed on <br />additional buffer strip landscaping between the proposed home and wetland, <br />should the Watershed deem the additional landscaping beneficial for wetland <br />protection. <br /> <br />F The review and approval of a building permit consistent with the approved plans <br />and variance. <br /> <br />7.0 PLANNING COMMISSION ACTION: <br /> <br />7.1 On Wednesday October 2, 2002, the Roseville Planning commission held the public <br />hearing regarding the Brucciani - Horvath variance request. At the hearing the City <br />Planner made a brief presentation detailing the specifics of the Brucciani - Horvath <br />variance request. The Commission did ask questions and indicate concern for the <br />distance separation (10 feet) from the wetland. The City Planner indicated that the <br />property owners were working very closely with the Rice Creek Watershed to obtain a <br /> <br />PF3431 - ReA 102102 - Page 4 of 5 <br />
