Planning File 3435:: Request by John & Martha Seal for a <br />Variance to Section1004.01A6 (Maximum Total Surface Area) and a <br />Variance to Section 1004.02.D5 (Setbacks - Rear Yard) of the Roseville City <br />Code to allow the construction of a four season porch.Mike Strub for a 25 <br />foot Variance to Section 1004.02.D4 of the Roseville City Code to allow for <br />construction of a detached accessory building at 1275 Burke Avenue. <br /> <br />Chair Duncan opened the hearing and requested City Planner Thomas Paschke <br />provide a summary of the project report dated October 2November 6,2002. <br /> <br />Thomas Paschke indicated John & Martha Seal, 3110 Evelyn Street, submitted <br />an application seeking approval of a variance to construct a dining room addition <br />(13'x 16') onto the rear of their home that will encroach approximately 6 feet into <br />the required 30 foot rear yard setback and a variance to increase the impervious <br />coverage on the small parcel (9,050 sq. ft.) from the allowable amount of2,715 <br />square feet (30%) to 3,054 square feet (34%). <br /> <br />The proposed dining room addition would increase the principal structure size to <br />2,208 square feet and create a total impervious coverage of 3,054 square feet or <br />34%. The existing and proposed condition exceeds the Code requirement by 339 <br />square feet. <br />City records indicate that the existing principal structure lies between 40 and 42 <br />feet from the rear property line. Placing the 16 foot dining room addition onto <br />the home creates an encroachment of 6 feet. The existing coverage (2,846 square <br />feet) has been determined to be a legal pre-existing, non-conforming condition as <br />it existed prior to the Code amendment in 1999. <br /> <br />Based on the information provided and the findings in Section 5 of the project <br />repOli, staff recommends approval of a 6 foot rear yard variance to Section <br />1004.02D5 and a 4% impervious coverage variance (195 sq. ft.) to Section <br />lO04.01A6 of the Roseville City Code for John & Martha Seal, subject to the <br />following conditions: <br /> <br />a. All building and site improvements shall not exceed 3,054 square feet of <br />. . <br />ImperVIOUS area. <br /> <br />b. Verification by the property owner on a site plan of the exact distance the <br />existing stricture lies from the rear property line. <br /> <br />c. The dining room addition being limited to a 16 foot extension of the <br />existing principal structure, as indicated on the plans, which addition <br />would encroach 6 feet into the required 30 foot rear yard setback. <br /> <br />d. The review and approval of a building permit consistent with the <br />approved plans and variance. <br /> <br />e. The installation of roof gutters along the southern side to properly direct <br />roof drainage away from the adjacent property. <br />
