<br />4.0 VARIANCE REQUEST BACKGROUND: <br /> <br />4.1 Section 1004.0lA6 of the Roseville City Code (Maximum Total Surface Area) affords <br />each residential property owner up to 30% impervious coverage on a lot/parcel, based <br />upon the total lot size. In the case of the Seal property this allowance cannot exceed <br />2,715 square feet without an approved variance. <br /> <br />4.2 The Seal home was constructed in 1977 and is situated on a 9,050 square foot parcel. <br />The horne/garage has a footprint estimated at 2,000 square feet, a driveway area of702 <br />square feet, and a patio of 144 square feet. This gives the Seal property an existing <br />coverage of 2,846 square feet or 131 square feet (1 %) over that allowed by the Code. <br />The excess has been determined to be a legal pre-existing non-conforming condition, <br />because it existed prior to the Code (Section 1004.0lA 1 - 15; as amended in 1999). <br /> <br />4.3 The proposed 13 foot wide (north/south) by 16 feet deep (east/west) dinning room <br />addition (208 sq. ft.) would be constructed on to the southeast corner of the home <br />adjacent to the existing dining room and kitchen. <br /> <br />4.4 The proposed dining room addition would increase the principal structure size to 2,208 <br />square feet and create a total impervious coverage of 3,054 square feet or 34%. The <br />existing and proposed condition exceeds the Code requirement by 339 square feet. <br /> <br />4.5 In 1977 Cave's North Boundary Addition was approved by the Roseville City Council. <br />This subdivision plat, however, appears to have been approved with a substandard <br />dimension. Specifically, parcels in the plat either do not meet the minimum required <br />depth, width, or both, which in the case of the Seal's property creates a lot with only <br />9,050 square feet. In addition, lots to the east, facing Prior Circle, have nearly 200 feet of <br />depth and structures that are setback over 60 feet from the cornmon rear property line. <br /> <br />4.6 The City Code, established in 1959 and amended in 1962 (Section 1005.02D5) requires a <br />minimum depth of 110 feet, a minimum width of 85 feet and a minimum lot size of <br />11,000 square feet. A search of the records pertaining to this action does not indicate any <br />formal action by the City Council regarding a variance to width, depth, or lot size, but <br />may have been considered an implicit variance as part of the subdivision approval. <br /> <br />4.7 City records indicate that the existing principal structure lies between 40 and 42 feet from <br />the rear property line. Placing the 16 foot dining room addition on to the home creates an <br />encroachment of 6 feet. <br /> <br />4.8 A 144 square foot patio has been included in the impervious coverage total. <br /> <br />PF3435 - ReA 111802 - Page 2 of 5 <br />
