EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> * * * * * * * * * * * * * * * * * <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br /> of Roseville, County of Ramsey, Minnesota, was duly held on the 10th day of December, <br /> 2012, at 6:00 o'clock p.m. <br /> The following members were present: Pust, Johnson, Willmus, McGehee, and Roe and <br /> the following were absent: None. <br /> Councilmember Pust introduced the following resolution and moved its adoption: <br /> RESOLUTION No. 11037 <br /> RESOLUTION ADOPTING SPECIAL ASSESSMENT POLICY <br /> WHEREAS, Special assessments are a charge imposed on properties for a particular public <br /> improvement that benefits the owners of those selected properties, and; <br /> WHEREAS, The authority to use special assessments originates in the state constitution <br /> which allows the state legislature to give cities and other governmental units the authority"to <br /> levy and collect assessments for local improvements upon property benefited thereby."The <br /> legislature confers that authority to cities in Minnesota Statutes Chapter 429, and; <br /> WHEREAS,the City Council recognizes that it is in the best interests of the City to adopt an <br /> assessment policy to assure uniform and consistent treatment of affected properties, and; <br /> WHEREAS, this resolution adopting supersedes the following previously adopted <br /> resolutions: <br /> • RESOLUTION 7506: Resolution Authorizing Amendment And Consolidation Of <br /> All Previously Adopted Special Assessment Policies Into One Resolution (5/9/83) <br /> • RESOLUTION 8012: Resolution Authorizing Amending Section 2 (B) Of <br /> Previously Adopted Assessment Policies Identified In Resolution No. 7506 By <br /> Eliminating This Section On Assessment Rates (9/22/86) <br /> • RESOLUTION 8995: Resolution Amending Assessment Policy(9/27/93) <br /> • RESOLUTION 9703: Approval Of Revision To The Existing Assessment Policy <br /> To Defer Assessments To Open Space Properties (10/25/99) <br /> THEREFORE,BE IT RESOLVED by the City Council of the City of Roseville,Minnesota <br /> to adopt the SPECIAL ASSESSMENT POLICY attached to this resolution as Exhibit A. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Member <br /> Willmus, and upon vote being taken thereon, the following voted in favor thereof: Pust, <br /> Johnson, Willmus, McGehee, Roe and the following voted against the same: None. <br /> WHEREUPON said resolution was declared duly passed and adopted. <br />
