<br />WHEREAS, the Roseville Planning Commission held the public hearing regarding the <br />Humphrey variance request to Section 1004.02D5 of the Roseville City Code on January 8, <br />2003, and recommended (5-0) approval of the variance and minor subdivision request, based on <br />findings outlined in Section 5 and conditions of Section 6 of the project report dated January 8, <br />2003; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant Dennis <br />& Patricia Humphreys 45 foot variance to Section 1004.02D5 of the Roseville City Code to <br />allow a minor subdivision of property at 331 Burke Avenue into two parcels, based on the <br />findings in Section 5 and of the project report dated January 27,2003, and subject to the <br />following conditions: <br /> <br />a. Approval of the Minor Subdivision creating two parcels for the large existing <br />parcel at 331 Burke Avenue, with minimum requirements including: a parcel <br />for the existing home 110 feet by 160 feet deep and a parcel for development <br />of a home with a minimum width adj acent to Burke Avenue of 40 feet. <br /> <br />b. The applicant providing the City with a survey of the new parcels with their <br />legal descriptions and illustrating the existing house and other site <br />improvements. <br /> <br />c. A five-foot wide utility and drainage easement adjacent to the west and north <br />property line of the parcel for the existing house (as required by the City <br />Engineer). <br />d. Provision of the appropriate park dedication and sewer accessibility charge <br />fees. <br /> <br />e. Submittal of a site, grading, driveway, and utility plan that will be reviewed <br />and approved by the Public works and Community Development Departments <br />prior to building permit issuance. <br /> <br />f. The applicant providing the City with the appropriate recording medium <br />necessary for City approval in order to properly record the subdivision <br />document with Ramsey County. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Kysylyczyn and upon vote being taken thereon, the following voted in favor: Maschka, <br />Kough, Schroeder, Klausing, Kysylyczyn <br /> <br />and the following voted against: None <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
