<br />2.4 Can an ADD be established on a lot there are two single-family units or townhomes on the <br />lot? <br />An accessory dwelling unit may not be established on a lot of record with two or more single- <br />family residences. <br /> <br />2.5 Would an accessory dwelling need a building permit? <br />Yes. Before receiving a building permit to establish an accessory dwelling, the applicant must <br />record a ADD pem1it which requires the owner to occupying one of the dwellings on the lot. An <br />ADD must comply with applicable building, fire, and health and safety codes. An ADD cannot be <br />occupied until a Certificate of Occupancy is issued. An accessory unit rentallicense/inspection <br />could be required that would compliance with the City Code. <br /> <br />2.6 Does an ADD have to connect to water and sewer? <br />Yes. An accessory dwelling unit must connect to public sewer and water. <br /> <br /> <br />2.7 What is the maximum area allowed for an accessory dwelling within the primary dwelling? <br />The total gross floor area of an accessory dwelling must not exceed forty percent of the area of <br />the primary dwelling's living area, excluding uninhabitable floor area, the garage or other <br />outbuildings. If the accessory dwelling unit is a separate building on the site, in addition to the <br />forty percent size requirement, the ADD along with all other impervious surfaces cannot exceed <br />thirty percent of the site. <br /> <br />2.8 Are there any restrictions on building heights? <br />The building height for an ADD is limited to two stories or 30 ft either in a detached or attached <br />accessory dwelling unit. <br /> <br />2.9 Can an accessory dwelling unit be created if a Home Occupation activity is also present? <br />An accessory dwelling can be created with or adjacent to an operating home occupation but only <br />with site plan approvals because it may complicate noise, odor, parking and traffic issues. The <br />property owner could operate the home occupation while still renting out the attached ADD. <br /> <br />2.10 What about parking spaces? <br />On-site paved parking is required for an accessory dwelling. Garages are not required, but <br />maximum impervious surface requirements do apply. Many smaller lots may not be have the <br />capacity for an ADD. <br /> <br />2.11 Are there design guidelines that are applicable to an ADD? <br />The accessory dwelling must follow existing design guidelines to conform to the existing <br />primary dwelling unit, including exterior materials, trim on edges of elements, windows and, <br />pediment and dormers. Plain concrete, concrete block, corrugated metal, or plywood are <br />prohibited if they are not the predominant existing exterior finish material on the primary <br />dwelling. <br /> <br />2.12 What is the application process? <br />A standard public hearing and approval of a conditional use permit is required in most <br />communities. One condition could be that the owner is occupying one of the dwellings units on <br />the lot. The conditional use permit and the conditions are recorded with the property at the <br />County Recorder's Office.
