Section 1009.04 (Variances) of the City Code explains that the purpose of a variance is “to <br />130 <br />permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />131 <br />parcel of land or building that prevent the property from being used to the extent intended by the <br />132 <br />zoning.” The proposal appears to compare favorably with all of the above requirements essential <br />133 <br />for approving variances. Moreover, the Planning Division believes the cumulative impacts of the <br />134 <br />Tree Preservation and Replacement requirements and those requirements for landscaping in the <br />135 <br />Property Performance Standards need to be modified to address situations where tree <br />136 <br />replacement and landscaping do not require a development on a 1-1/2 acre parcel to plant 83 <br />137 <br />total trees. <br />138 <br />Roseville’s Development Review Committee (DRC) met on December 3, 2014, to discuss this <br />139 <br />application, where members indicated support for the redevelopment and the variances necessary <br />140 <br />to support tree preservation and the site improvements. <br />141 <br />PC <br />UBLICOMMENT <br />142 <br />At the time this report was prepared, Planning Division staff has not received any <br />143 <br />communications from the public about the variance request. <br />144 <br />RA <br />ECOMMENDEDCTION <br />145 <br />Adopt Variance Board Resolution 111 <br />approving variances to §1011.03.C and §1011.04.G of <br />146 <br />the City Code to allow Pizza Lucéto construct a new restaurant and other required site <br />147 <br />improvements at 2851 Snelling Avenue, subject to the following conditions: <br />148 <br />a. <br />Pizza Lucé and their developer will be responsible for preserving the 4 trees indicated in <br />149 <br />the Tree Preservation Plan in accordance with the requirements of §1011.04.G. Should <br />150 <br />the trees not survive all attempts to protect and preserve, the island created for <br />151 <br />preservation shall be planted with a minimum of 4 4-inch canopy trees. <br />152 <br />b. <br />All modifications approved with this variance shall be revised on the building permit <br />153 <br />plans sheets and submitted to the Roseville Codes Coordinator to be replaced in the <br />154 <br />appropriate and applicable plan sheet sets under review. <br />155 <br />AA <br />LTERNATIVECTIONS <br />156 <br />Pass a motion to table one or more of the items for future action. <br />a. Tabling beyond <br />157 <br />February 4, 2015 may require extension of the 60-day action deadline established in <br />158 <br />Minn. Stat. §15.99. <br />159 <br />Adopt a resolution to deny the requested approval. <br />b.
