<br />~~S tate" means the State of Minnesota. <br /> <br />"Tax Exempt Obligations" means Tax Increment Bonds as to which the interest is not <br />includable in gross income for federal income tax purposes. <br /> <br />~~Tax Increment" means that portion of the real property taxes paid with respect to the <br />Redevelopment Property which is remitted to the City as tax increment pursuant to the Tax <br />Increment Act. <br /> <br />"Tax Increment Act" means the Tax Increment Financing Act, Minnesota Statutes, Sec. <br />469.174 et seq., as amended. <br /> <br />"Tax Increment Bonds" means the tax increment revenue bonds described in Section 4.7. <br /> <br />"Tax Increment District" means a Tax Increment Financing Distlict, which will include <br />the Redevelopment Property, created by the City within Development District No. 1 pursuant to <br />the Tax Increment Act. <br /> <br />"Tax Increment Note" has the meaning given to that term in Section 4.6. <br /> <br />"Tax Increment Plan" means the Tax Increment Financing Plan adopted for the Tax <br />Increment District. <br /> <br />"Termination Date" means the expiration date of this Agreement set forth in Article X. <br /> <br />"Unavoidable Delays" means unexpected delays which are the direct result of adverse <br />weather conditions, shortages of materials, strikes, other labor troubles, fire or other casualty to <br />the Minimum Improvements, the Redevelopment Property or the equipment used to construct the <br />Minimum Improvements, acts or war or terrorism, litigation or administrative appeals <br />commenced by third parties which by injunction, other judicial or administrative action directly <br />results in delays, or acts of any federal, state or local governmental unit other than those provided <br />for under this Agreement or any other cause or force majeure beyond the control of Redeveloper <br />which directly results in delays. <br /> <br />"Underwriter" means an investment banking firm selected by the City after consultation <br />with the Redeveloper. <br /> <br />6 <br />
