<br /> <br />2 <br />3 1 <br />4 Highway 8. <br /> <br />5 Chair Mulder opened the hearing and requested the City Planner present the verbal <br />6 summary of the staff report dated March 3, 2004. <br />7 <br />8 Thomas Paschke explained that ChrisINoelle Olson, 2940 Old Highway 8, seek approval <br />9 of a 54 foot Variance from Section 1004.0 1A 7 (Location) and a Conditional Use Permit <br />10 in accordance with Section 1004.01A4 of the Roseville City Code to allow the <br />II construction of a 980 sq. ft detached garage in the front yard. <br />12 <br />13 The applicant seeks approval of a 980 sq. ft detached accessory building that would <br />14 increase the impervious total on the parcel to approximately 4,669 sq. ft. The accessory <br />15 building square footage exceeds the size of the home. Staff calculated the home to be <br />16 1,150 sq. ft., the attached garage to be 230 sq. ft., and the proposed detached accessory <br />17 building to be 980 sq. ft. This gives the parcel a proposed total accessory building square <br />18 footage of 1,210 sq. ft. or 60 sq. ft. over the parcel's allowance. Staff did not recommend <br />19 a Variance to allow the overage. <br />20 <br />21 Thomas Paschke explained setbacks allowed within the front yard for a principle <br />22 structure. <br />23 <br />24 Staff reviewed this proposal and determined that it is difficult to justify a departure from <br />25 the strict application of Section 1004.01A5 (Overall Area) of the City Code allowing the <br />26 applicant to construct a 980 sq. ft. detached accessory building. The Staff recommended <br />27 not issuing a Conditional Use Permit. The Staff determined there is justification for <br />28 reducing the accessory building to 26 feet by 32 feet or 832 sq. ft, which eliminates the <br />29 need for a Conditional Use Permit and eliminates the need for one Variance to Section <br />30 1004.01A5. It does, however, require a Variance to Section 1004.01A7 (allowance in <br />31 front yard). <br />32 <br />33 The Staff recommended approval of a Variance to Section 1004.0 lA 7 (Location) and a 3 <br />34 foot Variance to Section 1004.02D5 (Dwelling Dimensions - Side Yard Setback) of the <br />35 Roseville City Code for ChrisINoelle Olson to allow the construction of a detached <br />36 accessory building in the front yard at 2940 Old Highway 8, based on the findings in <br />37 Section 5 of the project report dated 03/03/04, and the following conditions: <br />38 <br />39 a. The attached garage being limited to a depth of 26 feet, a length of 32 feet, <br />40 and an overall size of 832 sq. ft. <br />41 <br />42 b. A minimum side yard setback not to encroach closer than 7 feet to the side <br />43 yard (north) propeliy line. <br />44 <br />45 c. A minimum front yard setback of 30 feet. <br />46 <br /> <br />
