<br />STAFF <br /> <br /> <br />5.1 Section 1004.01A7 (Location) "No accessory building or shed <br />erected or located within any front yard. Accessory buildings and/or garden shed shall be <br />located behind the front building line of the principal structure. On through lots, <br />lakeshore lots, accessory buildings and/or garden shed may be located between the road <br />right-of-way line and the principal structure, provided they meet the required front yard <br />setback of 30 feet". The proposal by Mr. Olson, to construct a detached 980 sq. ft. <br />accessory building (garage) in the front yard, would place the structure <br />approximately 12 feet from his front property Hne. .With the existing principal <br />structure located approximately 66 feet from the front property line, the detached <br />accessory building would require a variance (54 feet) to be placed in the fron yard <br />12 feet from the front property Hne. <br /> <br /> <br />5.2 Section 1004.0lA4 (Requirements for Increased Size) reads: "The size of detached <br />accessory buildings may be increasedfi'om a total of864 sq. ft. to a maximum total size <br />of 1,008 sq. ft. A public hearing and approval of a conditional use permit in accordance <br />with 1013.01 of the title, and provided all applicable provisions of this section are met, is <br />necessary. The proposed 980 sq. ft. detached accessory building requires a <br />conditional use permit. <br /> <br />5.3 Section 1004.01A5 (Overall Area) reads: "The overall area of attached garage and <br />detached accessory buildings shall not exceed the exterior dimensional footprint of the <br />principal structure, excluding any attached garage footprint". The Olson principal <br />structure has been estimated at 1,150 square feet in size and the existing attached <br />garage estimated at 230 sq. ft., which leaves 920 sq. ft. of useable accessory building <br />square footage. The proposal to construct a 980 sq. ft. detached accessory building <br />exceeds the maximum amount allowed by the Code by 60 sq. ft., an amount that is <br />not supported by staff. <br /> <br />5.4 Section 1004.01A8 (Minimum Setback) reads: "A garden shed and/or accessory <br />buildings shall be set back a minimum of 5 feet from a side or rear yard lot line and a <br />minimum of 6 feet from any other building on the same lot or parcel." The building code <br />would prescribe special requirements (specifically increased fire rating between walls) <br />for those structures closer than 6 feet to one another. The recommendation by the <br />Community Development Department seeks a 3 foot variance to the code section to <br />allow the detached accessory building to be placed 7 feet from the north side yard <br />property Hne. <br /> <br />5.5 The Olsons have options available to them for increasing accessory building space on the <br />parcel. Specifically, the Olsons could build a detached garage in their rear yard, but this <br />structure would be challenging to construct and difficult to access, especially given the <br />steep slope to the rear yard and the extremely long/steep driveway. The Olsons could <br />also construct an attached garage adjacent to the existing attached single stall garage. <br />This structure would require excessive footings or a basement due to steep rear yard <br />slope.
