3 4 5 6 SECTION 2. Development Moratorium. The Roseville City Council hereby adopts a 7 development moratorium pursuant to M.S. 462.355, Sub. 4, on the receipt of and processing of 8 requests for rezoning, building permits (except as described in Section I.B), conditional use 9 permits, variances and subdivision of land within the Twin Lakes Master Plan area as identified lOin the general description below and in the 2002 Comprehensive Guide Plan. l1 12 SECTION 3. Duration of Moratorium. The development moratorium shall commence on the l3 effective date of this ordinance and may continue for up to one year from the date of adoption l4 unless otherwise terminated or extended by action of the City Council. 15 l6 SECTION 4. Exceptions. The development moratorium shall not apply to the Master l7 Developer's requests for applications, permits, and/or approvals consistent with the development l8 agreements(s) in effect at the date of the application. The development moratorium shall not 19 apply to permits for life safety, maintenance and repair (including exterior and on-site 20 modifications and improvements and access doors and docks, which do not extend the existing 21 basic building footprint), interim uses, signage, fencing, public infrastmcture, streets, 22 streetscapes, utilities, public facilities, K-12 schools, and parks. The City's Comprehensive Guide 23 Plan, Official Controls, and Building Code Regulations shall continue to apply to these 24 exceptions. 25 26 SECTION 5. Enforcement. The City ofRoseville may enforce any provision of this ordinance 27 by mandamus, injunction, or any other appropriate civil remedy in any court of competent 28 jurisdiction. 29 30 SECTION 6. Separability. Every section, provision, or part of this ordinance is declared 3l separable from every other section, provision, or part ofthis ordinance. If any section, provision, 32 or part ofthis ordinance is adjudged to be invalid by a court of competent jurisdiction, such 33 judgment shall not invalidate any other section, provision, or part of this ordinance. 34 35 SECTION 7. Effective Date. This Ordinance shall be effective upon adoption and publication. 36 37 38 SECTION 8. Moratorium Application. The development moratorium shall not apply to the 39 Master Developer requests for applications, permits and/or approvals consistent with the 40 development agreement(s) effective upon the application date. 4l 2
