<br />CITY OF CIRCLE PINES <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br /> <br />ORDINANCE NO. 86 <br />(Second Series) <br /> <br />INTERIM ORDINANCE TO PROTECT <br />THE PLANNING PROCESS AND THE HEALTH, SAFETY AND WELFARE OF <br />THE RESIDENTS OF THE CITY, AND TO RESTRICT THE ISSUANCE OF <br />BUILDING PERMITS FOR CONSTRUCTION OF FENCES <br />ON PROPERTY THAT ABUTS GOLDEN LAKE <br /> <br />THE CITY COUNCIL OF THE CITY OF CIRCLE PINES ORDAINS: <br /> <br />SECTION 1. Statement of Findin2s and Purpose. The City's zoning <br />ordinance may not adequately regulate the construction of fences on property with rear <br />yards that abuts Golden Lake. As part of its planning efforts, the City has authorized a <br />planning study to determine to what extent fences should be regulated on property with <br />rear yards that abuts Golden Lake. The City Council is aware that the City has been <br />asked to consider, or may in the future be asked to consider, applications for building <br />permits to construct perimeter fences on property located within the area to be studied. <br />The Council finds that the consequences of allowing such applications to be approved <br />may be contrary to the utilization of shorelands of protected waters and the preservation <br />of water quality, natural characteristics, economic values and the general health, safety <br />and welfare of the City and its residents because the current ordinance may be <br />inconsistent with the City's zoning and development goals. The Council therefore finds <br />that it is necessary to complete its study to consider the potential impact of construction <br />of fences and to consider the adoption of appropriate amendments to the existing zoning <br />code to ensure protection of the public health, safety and welfare. The Council further <br />finds that it would be imprudent and contrary to the health, safety and welfare of the <br />City's residents to allow fence construction to occur in the areas in question before <br />completion of the planning study. The Council has therefore determined that there is a <br />need for an interim ordinance to ensure that the City and its residents retain the benefits <br />of, and the protection sought to be afforded by, the City's zoning ordinance until the <br />planning study is completed and any modifications to the City's zoning regulations are <br />effective. <br /> <br />SECTION 2. Affected Area. This ordinance shall apply to all property with <br />rear yards that abuts Golden Lake. <br /> <br />SECTION 3. Temporarv Prohibition of Fence Permits. Commencing on the <br />effective date of this Ordinance and continuing until May 1,2005, no property within the <br />
