DPW
Item Description:

Amendment to text of City Code Title 4, Section 407.02, Subsection
407.02G specifically relating to the raising and keeping of poultry and
bees within the City of Roseville (PF 3557)

1.0 BACKGROUND:

1.1 The City of Roseville City Code is a compilation of ordinances, many of which date back to the
early 1950s. At that time the City had numerous small farms in the community. Some raised pigs,
poultry, and other livestock, while others raised flowers and vegetables. The density of residents
was 20% of the current development pattern. The natural environment could absorb the nutrients,
noises, and nuisances normally associated with agricultural production. Today there are no
agricultural zones remaining in the community.

1.2 The City Code Section 407.02 attempts to identify nuisances affecting health, safety,
comfort or repose. Subsection 407.02G states that the keeping of farm animals is such a
nuisance. However, it does not mention bees and poultry.

1.3 City Code staff has received a number of complaints about poultry, especially roosters
and turkeys. Complaints a varied: fear of the birds, the noise and smell, and the animal
waste runoff. In addition, staff has concerns that birds may be raised for fighting (other
suburban communities have experienced this cock fighting phenomena). Regarding bees,
the purposeful raising and keeping of bees for the production of honey creates a serious
health concern for residents (especially the young and elderly) with adverse reactions to
bee stings. The City Code currently states that such agriculture activities cannot occur
within 300 feet of any residential lot. Bees obviously range further than 300 feet from the
man-made hive and cannot be controlled.

2.0 RECOMMENDATIONS:

Because of the health and safety reasons listed above, the staff recommends changing the
code by adding bees and poultry to the list of farm animals which are prohibited from
being kept or raised in the City.

3.0 SUGGESTED COUNCIL ACTIONS:

3.1 Review draft ordinance. Discuss and provide direction.

3.2 Set a date at which to hold a first reading of the proposed ordinance.

Report Prepared by: Dennis Welsch, Com.
