Councilmember Schroeder reviewed his interpretation of Roberts <br />Rules of Order, and questioned why the item was back on the agenda. Councilmember <br />Schroeder requested that, if the item were to be reconsidered, the neighborhood would be <br />notified again of the Council's reconsideration. <br /> <br /> <br />Mayor Klausing provided his interpretation of Roberts Rules, and tonight's request that the <br />item be put on a June meeting agenda, and deferred to City Attorney Anderson for his <br />legal opinion. <br /> <br />City Attorney concurred with Mayor Klausing's interpretation of Roberts Rules and his <br />previous legal opinion, noting that tonight's request to add the item to a future agenda for <br />reconsideration was accurate. <br /> <br />DRAFT Minutes of OS/24/04 - Item #6 <br /> <br />6. <br /> <br />Vernon Albertson Application for a Two Lot Minor <br />Subdivision of Property at 3103 Asbury (PF 3556) <br />Mayor Klausing noted that the City Council was not <br />reconsidering this item tonight to allow adequate notification to <br />the public prior to further discussion. <br /> <br />Vernon Albertson <br />Two Lot Minor <br />Subdivision <br />3103 Asbury <br />(PF 3556) <br /> <br />Attorney Dan Wall, representing the Albertsons <br />Mr. Wall reviewed the process to-date, and opined that the <br />Council's discussion at the May 10, 2004 meeting and <br />subsequent action to deny had to do with the current City <br />ordinance, noting that the other policy items alluded to by <br />Councilmembers were not applicable to the discussion and <br />should not have been under consideration at that time related to <br />the requested action. Mr. Wall noted the potential hardship to <br />the Albertsons by waiting until June 14 and their plans for selling <br />and moving. Mr. Wall noted that additional work if the request <br />is granted (i.e., survey work, drawing up of new abstract, <br />recording) would further delay the project and should be <br />considered by the City Council in their action tonight. Mr. Wall <br />encouraged the City Council to act on the item tonight, and <br />remove conditions numbers 3.8, 3.9 and 3.10 as noted in the staff <br />
