<br />5.9 is to to not <br />by the landowner: The Albertson situation is unique. While the lot is large enough <br />two homes, the original home was constructed in such a way that it limits <br />options/opportunities for the property. The property could also be divided into two <br />parcels that meet the minimum 85 foot width requirement of Section 1004.016 of the <br />Roseville City Code. However, this design is not practical, nor reasonable. The <br />Community Development Staff has determined that the plight of the landowner is <br />due to circumstances unique to the property not created by the landowner. <br /> <br />5.10 The variance, if granted, will not alter the essential character of the locality: Although <br />approving this variance would create a parcel that is narrower in width than the vast <br />majority of lots in the neighborhood (most lots are 100 feet wide), the 69 foot width is <br />appropriate given the current site conditions. By City Code, any home placed on the <br />newly created parcel will only be required to meet a 40 foot front yard setback. The <br />existing home is set back approximately 58 feet from the front property line. A newly <br />created parcel that is 85 feet wide could intrude into the front yard (perceived) area of the <br />existing home, creating an unwelcome situation. The Community Development Staff <br />has determined that a 16 foot lot width variance, if granted, will not alter the <br />essential character of the locality, nor adversely affect the public health, safety, or <br />general welfare, of the city or adjacent properties. <br /> <br />6.0 STAFF RECOMMENDATION: <br /> <br />6. I The Community Development Staffrecommends approval of a 16 foot VARIANCE to <br />Section] 004.0]6 of the Roseville City Code and a MINOR SUBDIVISION in <br />accordance with Section 1] 04.04E of the Roseville City Code for Vernon Albertson to <br />allow the creation of a 69 foot wide by 200 foot deep parcel adjacent to (south) 3] 03 <br />Asbury Street, based on the findings in Section 5 of the project report dated March 25, <br />2004 and the following conditions: <br /> <br />a. A detailed grading plan with the building slab or first floor elevation and existing <br />and proposed contours must be submitted to the City Engineer for review and <br />approval prior to building permit issuance for Parcel B. <br /> <br />b. The City policy is to accept park land or cash in lieu of land dedication for the <br />creation of new lots. In this case no park is planned near of on this site, therefore, <br />cash will be accepted in lieu of parkland dedication. The dedication fee is <br />$1000.00 for the newly created Parcel B. The fee will be collected prior to <br />issuance of a building permit on said Parcel B. <br /> <br />c. The City policy is to require payment of the Metro Area Sewer Availability <br />Charge (SAC) upon the issuance of a building permit. In this case, a SAC fee is <br />required and will be collected with the issuance of a building permit for Parcel B. <br /> <br />PF3556 RPCA 040704 Page 4 of 5 <br />
