<br /> <br />to due call and a <br />RoseviHe, County of Ramsey, Mimlesota, was held on the 1st day of September, at 5:00 p.m, <br /> <br />The following members were present: Chair Bakeman, and Members Doherty and Boerigter. <br /> <br /> <br />Variance Board Member Doherty introduced the following resolution and moved its adoption: <br /> <br />VB RESOLUTION NO.3 <br /> <br />A RESOLUTION APPROVING A 10 FOOT VARIANCE TO SECTION 1009.03M OF <br />THE ROSEVILLE CITY CODE FOR ROSE OF SHARON, INC. (KINDERBERRY <br />HILL CHILD CARE), 2360 LEXINGTON AVENUE (PF3596) <br /> <br />WHEREAS, Rose of Sharon, Inc, on behalf of Kinderberry Hill Child Care, has requested <br />a VARIANCE to Section 1009,03M (Ground Signs) of the Roseville City Code to allow the <br />installation of a ground (monument) sign within the required setback adjacent to Lexington <br />Avenue; and <br /> <br />WHEREAS, Kinderberry Hill Child Care is located at 2360 Lexington Avenue, and <br />legally described as: <br /> <br />Lot 1, Block 1, Rose of Sharon 2nd Addition <br />PIN 11-29-23-32-0047 <br /> <br />WHEREAS, 1009.03M requires all ground signs to be set back a minimum of 15 feet <br />from a property line; and <br /> <br />WHEREAS, the proposal by Kinderberry Hill places the ground sign 5 feet from the <br />property line adjacent to Lexington Avenue; and <br /> <br />WHEREAS, the City Planner has concluded that "hardships" are present and support can <br />be given to deviate from the strict requirements of the Roseville City Code; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a <br />10 foot VARIANCE to Section 1009.03M of the Roseville City Code for Rose of Sharon, Inc, to <br />allow the installation of a ground (monument) sign at Kinderberry Hill Child Care, 2360 <br />Lexington Avenue, subject to the following condition: <br /> <br />1. The sign must be located a minimum of 5 feet from the property line adjacent to <br />Lexington Avenue. <br /> <br />2. The sign must meet all applicable requirements of Section 1009,04 and 1009,08 <br />of the Roseville City Code. <br /> <br />1 <br />
