<br /> <br />Community Development Department <br />651-792-7074 + fax: 651-792-7070 <br />VARIANCE BOARD ACTION NOTICE <br /> <br />September 3, 2004 <br /> <br />Dear Roseville Property Owner: <br /> <br />On Wednesday, September 1, 2004, the Roseville Variance Board unanimously approved the <br />request by Rose of Sharon, Inc. for Kinderberry Hill Child Care, 2360 Lexington Avenue <br />granting a 10 foot VARIANCE to Section 1009.03M of the Roseville City Code, allowing the <br />installation of a monument sign 5 feet from the property line adjacent to Lexington Avenue. <br />Should you desire to appeal the Variance Board's decision, an appeal must be filed as follows: <br /> <br />An appeal to the City Council, acting as the Board of Adjustment and Appeals, from the Variance Board <br />or an administrative ruling of the Comnnmity Development Director or his/her designee regarding any <br />intelpretation of the intent of this Title or Title 11 of this code, or any action approving or denying an <br />application related to any matter addressed in this Title or Title 11 of this code may be filed in writing by <br />any property owner or their agent with the City Manager within ten (10) calendar days after the making <br />of the order or decision being appealed. <br /> <br />1. An appeal stays all proceedings and the furtherance of the action being appealed unless it is <br />certified to the Board of Adjustment and Appeals, after the notice of appeal is filed, that by <br />reason of facts stated in the certificate a stay would cause imminent peril to life and <br />property. In such case, the proceedings shall not be stayed other than by a restraining <br />order that may be granted by a court of record on application, and upon subsequent notice <br />to the city. <br /> <br />2. The written appeal shall state the specific grounds upon which the appeal is made, and shall <br />be accompanied by a fee (same as residential variance request fee) established by resolution <br />of the city council. A hearing regarding the matter shall be held before the Board of <br />Adjustment and Appeal at its next regular meeting consistent with the notice requirements <br />and other procedures contained in Chapter 108 of this Code.
