<br />REQUEST FOR COUNCIL ACTION <br /> Date: 02-09-2015 <br /> Item No.: <br />15.a <br />Department Approval City Manager Approval <br /> <br />A request by the Community Development Department for Council to <br />Item Description: <br />review and comment on: proposed ordinance revisions to RoseRental <br />License Ordinance (City Code Chapter 908) and a policy regarding <br />Memorandums of Understanding. <br />B <br />ACKGROUND <br />1 <br />-Family Rental License Ordinance (Chapter 908) was approved by City Council on <br />2 <br />st <br />October 21, 2013. To date Community Development Department staff have implemented the <br />3 <br />ordinance and completed the initial inspection/licensing cycle. The first cycle of license renewals will <br />4 <br />occur in July of 2015 for those properties that had the most violations. <br />5 <br />In developing administrative procedures, assigning license types and conducting inspections, staff <br />6 <br />identified certain ordinance and process revisions which will correct minor discrepancies and <br />7 <br />contradictions in the ordinance, clarify some ordinance wording, allow for the ordinance to be operated <br />8 <br />more efficiently, and, provide a Council approved policy to guide staff. <br />9 <br />The following ordinance revisions to Chapter 908 and process changes are proposed: <br />10 <br /> <br />1.908.03: Change the number of individual units inspected at license renewal to 25% of rental <br />11 <br />dwelling units: <br />12 <br /> <br />While the ordinance identifies 100% of units to be inspected, the Implementation Plan <br />13 <br />st <br />(an attachment to the October 21 RCA approving the ordinance) called for inspecting <br />14 <br />33% of all dwelling units in each multi-family building. When the workload scheduling <br />15 <br />process occurred it was recognized that the 33% inspection level was not possible <br />16 <br />without adding staff and the program was adjusted to a 25% level for the initial cycle. <br />17 <br />The proposed text change codifies the practice that was followed and has previously <br />18 <br />been discussed with the City Council. <br />19 <br /> <br />Inspecting 25% of the total number of dwelling units in a building (units are chosen at <br />20 <br />random) allows for an adequate representation of the condition of dwelling units in a <br />21 <br />building. Many other cities with rental licensing programs also inspect a similar <br />22 <br />percentage of units. <br />23 <br /> <br />2.908.03.A: Rental licenses to expire as per the license type assigned, versus annually or semi- <br />24 <br />annually: <br />25 <br /> <br />Present ordinance language states that licenses will expire annually or semi-annually. <br />26 <br />However, both A and B type licenses run longer than annually.
