REQUEST FOR COUNCIL ACTION <br /> Date: February 9, 2014 <br /> Item No.: 8.e <br />Department Approval City Manager Approval <br />Item Description: Request by the Community Development Department for Authorization to <br />Enter into a Joint Powers Agreement with the St. Paul Port Authority <br />(SPPA) to Administer the Property Assessed Clean Energy Program <br />(PACE of MN) <br />B <br />ACKGROUND <br />1 <br />At the September 15, 2014 work session, the St. Paul Port Authority (SPPA) made a presentation <br />2 <br />about how it is working with cities across the state to promote clean energy programs and the <br />3 <br />specialized nature of its expertise. <br />4 <br />The Community Development Department brought this issue forward to the City Council in <br />5 <br />preparation for an anticipated request from St. Christopher’s Church to use the PACE program to <br />6 <br />fund a solar system on its property. St. Christopher’s had previously been in contact with St. <br />7 <br />Paul Port Authority regarding its financing needs. <br />8 <br />As indicated in the September 15, 2014 meeting, the City and the Port Authority have the power <br />9 <br />to amend or break the agreement at any time (although any existing loans or bonds would still be <br />10 <br />subject to the agreement in place at the time of their execution). <br />11 <br />The City Council directed staff to negotiate a draft agreement for consideration. The draft <br />12 <br />agreement is contained in Attachment A. <br />13 <br />Several changes were made to the draft document that was presented earlier in response to <br />14 <br />requests from the City Attorney and Staff. The changes did not make substantive changes to the <br />15 <br />concept that was presented at the September 15, 2014 meeting, but were added to clarify the <br />16 <br />procedures in the following situations: <br />17 <br />When an application is received <br />18 <br />In the event of non-payment by an applicant <br />19 <br />In the event that either partner wants to terminate the agreement <br />20 <br />As mentioned in the earlier City Council meeting, the St. Paul Port Authority is responsible for <br />21 <br />the implementation, administration and financing of improvements. The City of Roseville does <br />22 <br />not bear financial risk in the event of default. <br />23 <br />The St. Paul Port Authority has entered into similar agreements with many cities across the state. <br />24 <br />PO <br />OLICYBJECTIVE <br />25 <br />This action will promote the City Council’s clean energy and economic development goals by <br />26 <br />allowing private, non-profit and religious institutions to have access to the array of clean energy <br />27 <br />and energy efficiency programs that the SPPA administers.
