to a regular RoseviHe, County of Ramsey, Minnesota, was held on the 28th day of February, 2005 at p.m. The following members were present: Kough, Ihlan, Maschka, Schroeder, Klausing and the following Members were absent: None Member Kough introduced the following resolution and moved its adoption: RESOLUTION NO. 10281 A RESOLUTION APPROVING AN INTERIM USE PERMIT FOR MERITEX & SHAFER CONTRACTING AT 2880 WALNUT STREET (PF3616) WHEREAS, Shafer Contracting has requested an INTERIM USE PERMIT in accordance with Section 1012.09 of the RoseviHe City Code to allow the operation a temporary concrete recycling facility on a vacant piece of the Meritex parcel; and WHEREAS, the subject vacant parcel is triangular in configuration, located south of Terminal Road, east of Walnut Street and west of the Minnesota Commercial rail line, generally described as: Section 8 Township 29 Range 23 excluding a 17 foot wide right-of-way as described in Document 1663200, part of the Southwest y,. South of County Road B2, East of Walnut Street, and Northwesterly of Minnesota Transfer Railroad right-of-way, subject to easement for lead track. PIN 08-29-23-32-0001 WHEREAS, Section 1012.09A and B stipulates the requirements necessary to obtain an interim use permit; and WHEREAS, Shafer Contracting proposes to operate a temporary concrete recycling (crushing, storage, batch mixing, and delivery) site on the vacant triangular portion of the Meritex parcel; and WHEREAS, the RoseviHe Planning Commission held a public hearing regarding the interim use permit request of Meritex & Shafer Contracting and recommended (7-0) to approve the request, based on the comments outlined in Section 5 and the conditions of Section 6 of the project report dated 02/02/05. 1
