Attached is a 1967 survey <br />of Milner \\T. Carley & Associates, WhiCh sets forth the property that the Seller and Owner <br />thought was being conveyed. For some reason, the legal description on the survey, which was <br />the conect one, was not used. The result is a 33 foot gap between the O'HalIoran & Murphy Co. <br />property and the property now owned by North American Banking Company. <br /> <br />Attached is a recent survey by Sunde Land Surveying, LLC, which shows the property as <br />actually conveyed. It is the 33 feet east of the property described in the survey that is at issue. <br /> <br />According to the title insurance company, this 33 foot strip is in the name of William A. <br />Elling, who is now deceased. We have reached an agreement with the heirs of Mr. Elling to <br />convey the property to O'Halloran & Murphy Co. The Personal Representative's Deed and <br />other closing documents are in the process of being prepared. <br /> <br />We have also reached an agreement with North American Banking Company to obtain <br />from them a quit claim deed to the prope11y which includes this 33 foot strip. A copy of the <br />proposed deed is attached. According to the title company, the recording of these two deeds will <br />correct the title problem. <br /> <br />Doc# 1952177\1 <br />
