<br /> <br /> <br />Consent <br />Item request by O'HaUora~nd Murphy for a minor subdivision to <br />correct a lot line between two properties located at 2245 Hamline <br />Avenue (PF318) Parcel No: 102923340007 <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 O'Halloran and IVlurphy seek approval of a minor subdivision to correct legal description <br />and the location of the common lot line between the Mortuary and North American Bank. <br />No new lots will be created. The building setback requirements will continue to be met. <br />The site is designated for Limited Business in the Comprehensive Plan and on the City <br />Zoning map. The use is consistent with the limited business requirements. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Section 11.0404 D states: Corrections: When a surveyor description of a parcel or lot has <br />been found to be inadequate to describe the actual boundaries, approval of a corrective <br />subdivision may be requested. This type of subdivision creates no new lots or streets. The <br />proposed corrective subdivision, in sketch plan form, along with a letter signed by all <br />affected owners agreeing to the new subdivision, shall be submitted to the City Council <br />for approva1. No hearing or Planning Commission review is necessary unless the proposal <br />is referred to the Commission by the Community Development Director for clarification. <br />The proposed parcels shall not cause any portion of the existing lots, parcels, or existing <br />buildings to be in violation of this regulation or the zoning code. A certificate of survey <br />illustrating the corrected boundaries shall be required on all parcels. Within thirty (30) <br />days after approval by the City Council, the applicant shall supply the final survey to the <br />Community Development Director and City Manager for review and approval. After <br />completion of the reView and approval by the Community <br />Manager, the survey shall be recorded by the applicant with the Ramsey County Recorder <br />within sixty (60) days. Failure to record the subdivision within sixty (60) days shalI <br />nullify the approval ofthe subdivision. <br /> <br /> <br />2.2 The applicant's parcel lies directly west of the Hamline Avenue right of way and south of <br />Commerce Street. The incorrect property description is 33 feet short (east of) where the <br />property line should be located.
