Community Development Department
651-792-7005+ fax: 651.792-7070

December 1, 2004

Lucian Vittori
2225 Femwood Street
Roseville, MN 55113

Dear Mr. Vittori:

In my haste to provide you with an answer regarding your proposed attached garage addition, I
overlooked the existing City Code requirement and my previous comments. Specifically, the
City Code allows a Setback Permit to be granted for an encroachment no greater than 6 feet
(20%) into the required front yard or to a distance of 24 feet from the front property line. The
proposal Sussel Corporation provided the Building Permit Department indicates a 7 foot
encroachment into the required front yard setback or to a point 23 feet from the front property
line. This encroachment does not qualify for a Setback Permit, but rather would need to be
processed as a Variance.

I apologize for this recent oversight when I call you and indicated that your proposal could
proceed through the Setback Permit process. However, I do recall our initial conversation where
r indicated that a garage addition could be constructed 3 feet beyond the 30 foot required front
yard setback, if there was no living area above, or to a point 27 feet from the front yard property
line. Further, I recall noting that a Setback Permit could be considered for an encroachment to a
point 24 feet from the front yard propeliy line and a Variance could be considered for a greater
encroachment. Additionally, I indicating that I could review a proposal prior to permit submittal
to determine whether the desired addition would require formal approval.

In light of this information, I am unable to process a Setback Permit. I have attached a Variance
Application (and Setback Permit) for your review and completion, should desire to proceed
with the proposed attached garage as currently designed. I apologize for this inconvenience but
the City cannot issue permits that are inconsistent with its Codes and Ordinances. Should you
desire to discuss this matter, please call me at 651-792-7074.

Regards,

CITY of ROSEVILLE

Thomas Paschke
City Planner
Attachments:
