Specifically, the <br />City Code allows a Setback Permit to be granted for an encroachment no greater than 6 feet <br />(20%) into the required front yard or to a distance of 24 feet from the front property line. The <br />proposal Sussel Corporation provided the Building Permit Department indicates a 7 foot <br />encroachment into the required front yard setback or to a point 23 feet from the front property <br />line. This encroachment does not qualify for a Setback Permit, but rather would need to be <br />processed as a Variance. <br /> <br />I apologize for this recent oversight when I call you and indicated that your proposal could <br />proceed through the Setback Permit process. However, I do recall our initial conversation where <br />r indicated that a garage addition could be constructed 3 feet beyond the 30 foot required front <br />yard setback, if there was no living area above, or to a point 27 feet from the front yard property <br />line. Further, I recall noting that a Setback Permit could be considered for an encroachment to a <br />point 24 feet from the front yard propeliy line and a Variance could be considered for a greater <br />encroachment. Additionally, I indicating that I could review a proposal prior to permit submittal <br />to determine whether the desired addition would require formal approval. <br /> <br />In light of this information, I am unable to process a Setback Permit. I have attached a Variance <br />Application (and Setback Permit) for your review and completion, should desire to proceed <br />with the proposed attached garage as currently designed. I apologize for this inconvenience but <br />the City cannot issue permits that are inconsistent with its Codes and Ordinances.
