<br /> <br /> <br />Section 1004.01A7 does not permit an <br />yard a residential (R-l or R-2) zoned property. <br /> <br /> <br />to <br /> <br /> <br />III <br /> <br />proposal Mr. Stemm seeks approvals to construct the detached accessory building <br />32 feet from the front yard property line adjacent to Owasso Boulevard. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 The original structure (house) was built in 1969 and lies on an irregularly shaped lot that <br />is 100 feet wide along Owasso Boulevard; generally 289 feet deep; 70 feet wide at the <br />rear property line; and containing over 20,470 square feet (almost twice the required lot <br />size). The rear (west) lot line abuts Valley Park and pond area. <br /> <br />5.2 The Stemm principal structure (house) is set back approximately 120 feet from the <br />property line adjacent to Owasso Boulevard. The boulevard in front of the Stemm <br />property is approximately 30 feet in width from property line to the curb edge and <br />accommodates underground utilities and a pathway. The proposed accessory building <br />location (32 feet from the front property line and approximately 62 feet from the curb <br />line) requires an 88 foot Variance to Section 1004.01 A 7 of the Roseville City Code. <br /> <br />5.3 Principal structures (houses) on the west side of Owasso Boulevard are setback from 43 <br />to 50 feet from the road right of way and have few accessory buildings because of the <br />terrain, lot width and vegetation. However, on the east side of the street, because of the <br />lake frontage and the severe topography, there are numerous accessory buildings set <br />within 20 feet of the road right of way. <br /> <br />5.4 The Stemm property is not considered a lakeshore lot or a through lot and therefore the <br />accessory building must be set back at or behind the front building line, a distance 120+ <br />feet from the property line adjacent to Owasso Boulevard. <br /> <br />5.5 Section 1004.01A7 (Location) states: "No accessory building and/or a garden shed shall <br />be erected or located within any front yard. Accessory buildings and/or garden shall be <br />located behind the established front building line of the principal structure. On through <br />lots and lakeshore lots, accessory buildings and/or garden shed may be located between <br />the road right-of-way line and the principal structure, provided they meet the required <br />front yard setback of 30 feet". <br /> <br />5.6 The Stemm home is uniquely placed into the parcel and includes an attached two stall <br />garage. However, access to the side yard and/or the rear yard is difficult or impossible <br />due to mature trees and the slope of the parceL <br /> <br />PF362LRVBA_010505- Page 2 of5 <br />
