<br /> <br /> <br />1. Minnesota Statutes 9462.358, subd. 2b allows City to require <br />applicants to dedicate a reasonable portion of any subdivision for public use as parks, <br />playgrounds, trails, wetlands, or open space or an equivalent amount in cash. <br /> <br />The City Council finds that: <br /> <br />A) The preservation and development of parks, trails, and open space areas <br />within the City are essential to maintaining a healthy and desirable <br />environment for residents and persons employed within the City. Further, <br />the presence of parks, tails and open space within the City enhances the <br />value and attractiveness of residential and commerciallindustrial property. <br /> <br />B) New developments place a burden upon the City's parks systems. New <br />development requires new facilities in order to maintain the current level of <br />service and the quality of the environment. Therefore, new developments <br />shall be required to contribute toward the City's park system in rough <br />proportion to the relative burden they will place upon the park system, in <br />order to maintain the existing level of service to the community. All <br />applicable terms of this section shall be made part of all development <br />contracts or site plan approvals. <br /> <br />C) <br /> <br />Residential development of land creates approximately <br />the need for the park system within the City. <br /> <br /> <br />percent of <br /> <br />D) Commercial/industrial development of land creates approximately <br />percent of the need for the park system within the City. <br /> <br /> <br />Development of land for schools creates additional demand on City's <br />park system to the extent that the school serves students that do not live <br />within the City. <br /> <br />Subd.2. Definitions. The terms and words used in this section shall have the <br />[oIl owing meanings: <br /> <br />A) Applicant: Any person commencing an application for a division, <br />consolidation, rearrangement, subdivision, or re-subdivision of land, <br />including planned unit developments. An applicant is the owner of the land <br />or an individual representing the landowner who has express written <br />authority to act on behalf of the owner. <br /> <br />1 <br />
